As soon as possible after the ruling by which the surrender is granted in whole or in part, but no later than ten days after the date of this ruling, the requested person shall be physically surrendered. The public prosecutor shall determine the time and place, after consultation with the issuing judicial authority.

The court may, upon the application of the public prosecutor, extend the period stipulated in the first paragraph by a maximum of thirty days at a time, if this is necessary because the actual surrender cannot take place within that period due to circumstances beyond the control of any Member State. The public prosecutor shall submit the application after having agreed upon a new date with the issuing judicial authority that falls within the period to be extended. In that case, the actual surrender shall take place no later than ten days after the established date.

The court may, of its own motion, upon the claim of the public prosecutor or at the request of the requested person or their counsel, temporarily suspend the time limit referred to in the first paragraph if, due to serious humanitarian reasons, the actual surrender cannot, by way of exception, take place within that time limit. Serious humanitarian reasons shall in any event be deemed to exist if there are valid grounds to assume that the actual surrender would endanger the life or health of the requested person. If the court decides that the time limit set in the first paragraph is temporarily suspended, the public prosecutor shall notify the issuing judicial authority thereof without delay. As soon as these reasons, in the opinion of the public prosecutor or the requested person, no longer exist, the public prosecutor shall claim that the court extend that time limit by a maximum of thirty days, after having notified the issuing judicial authority thereof without delay and having agreed upon a new date with that authority that falls within the time limit to be extended. In that case, the actual surrender shall take place no later than ten days after the established date.

The deprivation of liberty of the requested person shall be terminated upon the expiry of the time limits referred to in the first to third paragraphs inclusive. The release shall not take place until the court, upon the motion of the public prosecutor, has had the opportunity to impose one or more of the following restrictive conditions, if this is necessary to prevent flight:

a.

an obligation to be present at a specific location at certain times or during a certain period;

b.

an obligation to report to a specific authority at specified times;

c.

a restriction of the right to leave the Netherlands;

d.

other restrictive conditions intended to prevent flight.

The court shall provide the requested person with the opportunity to be heard regarding the restrictive conditions. Electronic monitoring may be attached to these conditions.

The public prosecutor shall notify the issuing judicial authority without delay of a release as referred to in the fourth paragraph and of any conditions imposed in connection therewith.

Zo spoedig mogelijk na de uitspraak waarbij de overlevering geheel of gedeeltelijk is toegestaan, maar niet later dan tien dagen na de datum van deze uitspraak, wordt de opgeëiste persoon feitelijk overgeleverd. De officier van justitie bepaalt, na overleg met de uitvaardigende justitiële autoriteit, de tijd en plaats.

De rechtbank kan op vordering van de officier van justitie de in het eerste lid gestelde termijn telkens met ten hoogste dertig dagen verlengen, indien dit noodzakelijk is doordat als gevolg van omstandigheden buiten de macht van enige lidstaat de feitelijke overlevering niet binnen die termijn kan plaatsvinden. De officier van justitie dient de vordering in, nadat deze met de uitvaardigende justitiële autoriteit een nieuwe datum is overeengekomen die valt binnen de te verlengen termijn. De feitelijke overlevering vindt in dat geval uiterlijk tien dagen na de vastgestelde datum plaats.

De rechtbank kan, ambtshalve, op vordering van de officier van justitie of op verzoek van de opgeëiste persoon of diens raadsman, de in het eerste lid bedoelde termijn tijdelijk opschorten, indien door ernstige humanitaire redenen de feitelijke overlevering bij wijze van uitzondering niet binnen die termijn kan plaatsvinden. Van ernstige humanitaire redenen is in ieder geval sprake indien er gegronde redenen bestaan om aan te nemen dat de feitelijke overlevering het leven of de gezondheid van de opgeëiste persoon in gevaar zou brengen. Indien de rechtbank beslist dat de in het eerste lid gestelde termijn tijdelijk wordt opgeschort, stelt de officier van justitie de uitvaardigende justitiële autoriteit daarvan onverwijld in kennis. Zodra deze redenen naar het oordeel van de officier van justitie of van de opgeëiste persoon niet langer bestaan, vordert de officier van justitie dat de rechtbank die termijn met maximaal dertig dagen verlengt, nadat hij de uitvaardigende justitiële autoriteit daarvan onverwijld in kennis heeft gesteld en in onderling overleg met die autoriteit een nieuwe datum is overeengekomen die valt binnen de te verlengen termijn. De feitelijke overlevering vindt in dat geval uiterlijk tien dagen na de vastgestelde datum plaats.

De vrijheidsbeneming van de opgeëiste persoon wordt beëindigd na het verstrijken van de in het eerste tot en met derde lid genoemde termijnen. De invrijheidstelling gebeurt niet dan nadat de rechtbank op vordering van de officier van justitie één of meer van de volgende vrijheidsbeperkende voorwaarden heeft kunnen stellen, indien dit noodzakelijk is ter voorkoming van vlucht:

a.

een verplichting op bepaalde tijdstippen of gedurende een bepaalde periode op een bepaalde locatie aanwezig te zijn;

b.

een verplichting zich op bepaalde tijdstippen te melden bij een bepaalde instantie;

c.

een beperking van het recht om Nederland te verlaten;

d.

andere vrijheidsbeperkende voorwaarden die strekken ter voorkoming van vlucht.

De rechtbank stelt de opgeëiste persoon in de gelegenheid te worden gehoord over de vrijheidsbeperkende voorwaarden. Aan deze voorwaarden kan elektronisch toezicht worden verbonden.

6.

De officier van justitie stelt de uitvaardigende justitiële autoriteit onverwijld in kennis van een invrijheidstelling als bedoeld in het vierde lid en van daarbij gestelde voorwaarden.
