The court shall examine the identity of the requested person in the manner referred to in Article 27a, paragraph 1, first sentence, of the Code of Criminal Procedure, as well as the admissibility of the European arrest warrant and the possibility of surrender. The court is also authorised to establish the identity of the requested person in the manner referred to in Article 27a, paragraph 2, of that Code, if there is doubt regarding his identity. Article 29c, paragraph 2, of that Code shall apply mutatis mutandis.

The public prosecutor shall present his opinion on the requested surrender at the hearing of the court and shall submit to the court a written summary, in which, where applicable, the decision to discontinue the prosecution is stated. The requested person and his counsel shall also be given the opportunity to make relevant comments regarding the European arrest warrant and the decisions to be taken in connection therewith.

In the event of competing European arrest warrants, the public prosecutor shall also state to which of the European arrest warrants – insofar as surrender may be granted on the basis thereof – the court should, in his opinion, give priority, while taking into account the interest of the proper administration of justice and, furthermore, in particular:

a.

the greater or lesser gravity of the various offences for which surrender is requested;

b.

the place or places where the facts were committed;

c.

the dates of the respective European arrest warrants;

d.

the purpose of the surrender;

e.

the extent to which the nationality of the person claimed will constitute an impediment to surrender;

f.

the possibility that the requested person, after having been surrendered to the territory of one of the Member States concerned, is subsequently placed at the disposal of the issuing judicial authority of another Member State by the judicial authorities of that Member State.

If the court deems it necessary with a view to the investigation to be conducted by it pursuant to the first paragraph, it shall order, taking into account the time limits mentioned in Article 22 – if necessary, accompanied by an order for compulsory appearance – the summoning or written notification of witnesses or experts at a time to be determined by it.

De rechtbank onderzoekt de identiteit van de opgeëiste persoon op de wijze, bedoeld in artikel 27a, eerste lid, eerste volzin, van het Wetboek van Strafvordering, alsmede de ontvankelijkheid van het Europees aanhoudingsbevel en de mogelijkheid van overlevering. De rechtbank is tevens bevoegd de identiteit van de opgeëiste persoon vast te stellen op de wijze, bedoeld in artikel 27a, tweede lid, van dat wetboek, indien over zijn identiteit twijfel bestaat. Artikel 29c, tweede lid, van dat wetboek is van overeenkomstige toepassing.

De officier van justitie geeft ter zitting van de rechtbank zijn opvatting over de verzochte overlevering en legt een schriftelijke samenvatting, waarin, in voorkomend geval, de beslissing tot staking van de vervolging is vermeld, aan de rechtbank over. De opgeëiste persoon en diens raadsman worden eveneens in de gelegenheid gesteld tot het maken van ter zake dienende opmerkingen omtrent het Europees aanhoudingsbevel en de in verband daarmede te nemen beslissingen.

In geval van samenloop van Europese aanhoudingsbevelen vermeldt de officier van justitie eveneens aan welk van de Europese aanhoudingsbevelen – voor zover de overlevering op basis daarvan kan worden toegestaan – de rechtbank naar zijn oordeel voorrang zal geven, daarbij rekening houdend met het belang van een goede rechtsbedeling en voorts in het bijzonder met:

a.

de meerdere of mindere ernst van de verschillende feiten waarvoor de overlevering is gevraagd;

b.

de plaats of plaatsen waar de feiten zijn begaan;

c.

de data van de onderscheiden Europese aanhoudingsbevelen;

d.

het doel van de overlevering;

e.

de mate waarin de nationaliteit van de opgeëiste persoon een belemmering zal vormen voor verderlevering;

f.

de mogelijkheid dat de opgeëiste persoon, nadat hij naar het grondgebied van een van de betrokken lidstaten is verwijderd, vervolgens door de justitiële autoriteiten van die lidstaat ter beschikking wordt gesteld van de uitvaardigende justitiële autoriteit van een andere lidstaat.

Indien de rechtbank zulks met het oog op het door haar krachtens het eerste lid in te stellen onderzoek noodzakelijk acht, gelast zij, rekening houdend met de termijnen, genoemd in artikel 22, – zo nodig onder bijvoeging van een bevel tot medebrenging – tegen een door haar te bepalen tijdstip de dagvaarding of schriftelijke oproeping van getuigen of deskundigen.
