1.

The hearing of the person claimed shall take place in public, unless that person requests that the case be heard in camera or the court orders the doors to be closed for compelling reasons to be stated in the official report of the hearing.

The hearing shall take place in the presence of the public prosecutor.

During his interrogation, the requested person may be assisted by his counsel.

4.

If the summoned person has not appeared and the court deems his presence at the hearing desirable, the court shall, taking into account the time limits referred to in Article 22, order his summons for a time to be determined by the court, if necessary accompanied by an order for his apprehension.

If the person whose surrender is sought is a minor, the parents or guardian who have appeared and the representative of the Child Care and Protection Board (Raad voor de Kinderbescherming) who has appeared shall be given the opportunity to assist the minor.

Het verhoor van de opgeëiste persoon geschiedt in het openbaar, tenzij deze een behandeling van de zaak met gesloten deuren verlangt of de rechtbank om gewichtige, in het proces-verbaal der zitting te vermelden redenen sluiting der deuren beveelt.

Het verhoor heeft plaats in tegenwoordigheid van de officier van justitie.

Bij zijn verhoor kan de opgeëiste persoon zich door zijn raadsman doen bijstaan.

Is de opgeëiste persoon niet verschenen en acht de rechtbank zijn aanwezigheid bij het verhoor wenselijk, dan gelast de rechtbank, rekening houdend met de termijnen genoemd in artikel 22, tegen een door haar te bepalen tijdstip diens dagvaarding, zo nodig onder bijvoeging van een bevel tot medebrenging.

5.

Indien de opgeëiste persoon minderjarig is, worden verschenen ouders of voogd en de verschenen vertegenwoordiger van de raad voor de kinderbescherming in de gelegenheid gesteld de minderjarige bij te staan.
