in forceThe offences punishable under Article 10, paragraph 1, Article 10b, paragraph 1, and Article 11, paragraph 1, are petty offences (overtredingen).
The offences punishable under Articles 10, paragraphs two up to and including six, 10a, paragraph one, 10b, paragraph two, 10c, 11, paragraphs two up to and including five, 11a and 11b are indictable offences (misdrijven).
The Netherlands criminal law is applicable to anyone who, outside the Netherlands, commits:
one of the offences made punishable in Article 10a, paragraph 1, insofar as these have been committed in order to prepare or facilitate the offence made punishable in Article 10, paragraph 5, or
attempt to commit or participation in the offence punishable under Article 10, paragraph 5.
The Netherlands criminal law is applicable to one of the offences punishable under Article 10, paragraphs two up to and including five, Article 10a, paragraph one, 10b, paragraph two, 10c, Article 11, paragraphs two up to and including four, and Article 11a, if the offence has been committed on board a foreign vessel or a vessel without nationality or a vessel treated as such under international law, on the high seas, and action is taken in the context of the implementation of the Agreement for the implementation of Article 17 of the United Nations Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances.
De in artikel 10, eerste lid, 10b, eerste lid, en artikel 11, eerste lid, strafbaar gestelde feiten zijn overtredingen.
De in de artikelen 10, tweede tot en met zesde lid, 10a, eerste lid, 10b, tweede lid, 10c, 11, tweede tot en met vijfde lid, 11a en 11b strafbaar gestelde feiten zijn misdrijven.
De Nederlandse strafwet is toepasselijk op ieder die zich buiten Nederland schuldig maakt aan:
een der in artikel 10a, eerste lid, strafbaar gestelde feiten voorzover die zijn gepleegd om het in artikel 10, vijfde lid, strafbaar gestelde feit voor te bereiden of te bevorderen, dan wel
poging tot of deelneming aan het in artikel 10, vijfde lid, strafbaar gestelde feit.
De Nederlandse strafwet is toepasselijk op een der in artikel 10, tweede tot en met vijfde lid, artikel 10a eerste lid, 10b, tweede lid, 10c, artikel 11, tweede tot en met vierde lid, en artikel 11a strafbaar gestelde feiten, indien het feit is gepleegd aan boord van een buitenlands vaartuig dan wel een vaartuig zonder nationaliteit of een daarmee gelijk gesteld vaartuig uit hoofde van het internationale recht, op open zee, en wordt opgetreden in het kader van de toepassing van het Verdrag ter uitvoering van artikel 17 van het Verdrag tegen sluikhandel.
