This paragraph applies to package providers that distribute or cause to be distributed one or more programme packages to at least 100,000 subscribers in the Netherlands.
If a package provider distributes or causes to be distributed a programme offering by means of two or more broadcasting networks or broadcasting transmitters, the relevant numbers of subscribers shall be aggregated for the application of the first paragraph.
If a package provider is a legal entity, the number of subscribers of that package provider and the numbers of subscribers of the subsidiaries maintained by the package provider shall be aggregated for the purposes of the application of this article. If the package provider is a legal entity and a subsidiary maintained by another package provider, the number of subscribers of that subsidiary, the number of subscribers of the package provider that maintains this subsidiary, and the numbers of subscribers of the other subsidiaries maintained by this package provider shall be aggregated for the purposes of the application of this article.
Deze paragraaf is van toepassing op pakketaanbieders die een of meer programmapakketten naar ten minste 100.000 abonnees in Nederland verspreiden of laten verspreiden.
Als een pakketaanbieder programma-aanbod door middel van twee of meer omroepnetwerken of omroepzenders verspreidt of laat verspreiden, worden voor de toepassing van het eerste lid de desbetreffende aantallen abonnees samengevoegd.
Als een pakketaanbieder een rechtspersoon is, worden voor de toepassing van dit artikel samengevoegd het aantal abonnees van die pakketaanbieder en de aantallen abonnees van de dochtermaatschappijen die de pakketaanbieder in stand houdt. Als de pakketaanbieder een rechtspersoon is en een dochtermaatschappij die door een andere pakketaanbieder in stand wordt gehouden, worden voor de toepassing van dit artikel samengevoegd het aantal abonnees van die dochtermaatschappij, het aantal abonnees van de pakketaanbieder die deze dochtermaatschappij in stand houdt, en de aantallen abonnees van de andere dochtermaatschappijen die deze pakketaanbieder in stand houdt.
