A media institution providing a commercial on-demand media service shall invest in Dutch cultural audiovisual production.
The investment amounts to five percent of the relevant turnover per financial year.
The relevant turnover per financial year consists of all turnover generated in the Netherlands that is related to the offering of the relevant commercial on-demand media service. This includes turnover from:
advertising messages;
subscriptions;
user transactions;
sponsoring; and
product placement
The first paragraph shall not apply if the relevant turnover per financial year amounts to less than € 10 million.
The Commissariaat may grant a media institution as referred to in the first paragraph an exemption from the first paragraph if application thereof, in view of the nature or the subject matter of the media service concerned, or the use of innovative formats, would be practically unfeasible or unjustified.
The Commissariaat may lay down further rules regarding the exemption referred to in the fifth paragraph, which rules shall require the approval of Our Minister.
Een media-instelling die een commerciële mediadienst op aanvraag verzorgt, investeert in Nederlands cultureel audiovisueel product.
De investering bedraagt vijf procent van de relevante omzet per boekjaar.
De relevante omzet per boekjaar bestaat uit alle in Nederland gegenereerde omzet die verband houdt met het aanbieden van de betreffende commerciële mediadienst op aanvraag. Hiertoe wordt gerekend omzet uit:
reclameboodschappen;
abonnementen;
gebruikerstransacties;
sponsoring; en
productplaatsing.
Het eerste lid is niet van toepassing indien de relevante omzet per boekjaar minder dan € 10 miljoen bedraagt.
Het Commissariaat kan een media-instelling als bedoeld in het eerste lid ontheffing verlenen van het eerste lid indien toepassing gelet op de aard of het onderwerp van de betreffende mediadienst, of het gebruik van innovatieve formats, praktisch onuitvoerbaar of ongerechtvaardigd zou zijn.
Het Commissariaat kan nadere regels stellen over de ontheffing, bedoeld in het vijfde lid, welke regels de goedkeuring behoeven van Onze Minister.
