in forceIt is prohibited for the owner of an enterprise to use a trade name which, contrary to the truth, indicates that the enterprise belongs, in whole or in part, to another person.
Paragraph 1 shall also apply if the designation appearing in the trade name deviates only to such a slight extent from the name of that other person, that as a result confusion among the public of the latter with the owner of the enterprise is to be feared.
The first paragraph does not apply if the trade name and the enterprise originate from a person who has used that name not in contravention of this Act.
Het is de eigenaar ener onderneming verboden een handelsnaam te voeren, die in strijd met de waarheid aanduidt, dat de onderneming, geheel of gedeeltelijk aan een ander zou toebehoren.
Het eerste lid is mede van toepassing, indien de in de handelsnaam voorkomende aanduiding slechts in zo geringe mate van de naam van die ander afwijkt, dat dientengevolge bij het publiek verwarring van deze met de eigenaar der onderneming, te duchten is.
Het eerste lid is niet van toepassing, indien de handelsnaam en de onderneming afkomstig zijn van iemand, die die naam heeft gevoerd niet in strijd met deze wet.
