The supervisory judge may, upon the petition of the administrator or the debtor, or ex officio, determine by written order that the debtor is authorized to continue the exercise of his independent profession or business for the benefit of the estate during a period to be determined in that order. The supervisory judge may extend a period each time and attach conditions to his order.
An order as referred to in the first paragraph has the effect that the debtor is authorised to perform all acts for which the administrator has given permission and which are necessary for the normal exercise of the profession or business.
Claims arising from a continuation of the exercise of the profession or business to which the debtor is authorized pursuant to this article, including the rent due, insofar as attributable to that continuation, are debts of the estate.
De rechter-commissaris kan op verzoek van de bewindvoerder of de schuldenaar dan wel ambtshalve bij schriftelijke beschikking bepalen dat de schuldenaar gedurende een in die beschikking vast te stellen periode bevoegd is ten behoeve van de boedel de uitoefening van zijn zelfstandig beroep of bedrijf voort te zetten. De rechter-commissaris kan een periode telkens verlengen en aan zijn beschikking voorwaarden verbinden.
Een beschikking als bedoeld in het eerste lid heeft tot gevolg dat de schuldenaar bevoegd is alle handelingen waartoe de bewindvoerder toestemming heeft gegeven en die voor de normale uitoefening van het beroep of bedrijf nodig zijn, te verrichten.
Vorderingen die voortvloeien uit een voortzetting van de uitoefening van het beroep of bedrijf waartoe de schuldenaar op grond van dit artikel bevoegd is, waaronder te begrijpen de verschuldigde huurpenningen, voorzover aan die voortzetting toe te rekenen, zijn boedelschulden.
