Articles 57-59 do not apply when the mortgage rests on an aircraft that is registered in the public registers, referred to in Section 2 of Title 1 of Book 3 of the Civil Code, or in a treaty register as referred to in Article 1300 under d of Book 8 of the Civil Code.
Mortgagees whose rights rest on aircraft as referred to in the preceding paragraph, and other creditors who, pursuant to Article 1317 of Book 8 of the Civil Code, have a privilege on the aircraft, may exercise their right as if there were no bankruptcy. Article 57, second and third paragraphs, applies *mutatis mutandis*.
The bankruptcy trustee may set a reasonable time limit for these creditors to proceed with the exercise of their rights in accordance with the preceding paragraph. If the creditor has not sold the aircraft within this time limit, the bankruptcy trustee may sell the aircraft. The supervisory judge (rechter-commissaris) is competent to extend the time limit one or more times upon the application of the creditor.
To a sale by the bankruptcy trustee, Articles 584d and 584f-584q of the Code of Civil Procedure apply mutatis mutandis, with the proviso that the bankruptcy trustee is deemed to be an attaching party by virtue of a claim that is not endowed with any priority, and that the judgment declaring the bankruptcy is dealt with as prescribed for the official report of attachment.
The supervisory judge in the bankruptcy may in that case determine that a portion of the general bankruptcy costs to be determined by him shall be regarded as costs of execution within the meaning of Article 584n of the Code of Civil Procedure.
The curator may redeem the aircraft up to the time of the sale against payment of the amount due thereon, as well as of the costs of execution already incurred.
Article 59 applies mutatis mutandis.
De artikelen 57-59 zijn niet van toepassing wanneer de hypotheek rust op een luchtvaartuig dat te boek staat in de openbare registers, bedoeld in afdeling 2 van titel 1 van Boek 3 van het Burgerlijk Wetboek, of in een verdragsregister als bedoeld in artikel 1300 onder d van Boek 8 van het Burgerlijk Wetboek.
Hypotheekhouders wier rechten rusten op luchtvaartuigen als bedoeld in het vorige lid, en andere schuldeisers die op grond van artikel 1317 van Boek 8 van het Burgerlijk Wetboek een voorrecht op het luchtvaartuig hebben, kunnen hun recht uitoefenen, alsof er geen faillissement was. Artikel 57, tweede en derde lid, is van overeenkomstige toepassing.
De curator kan deze schuldeisers een redelijke termijn stellen om tot uitoefening van hun rechten overeenkomstig het vorige lid over te gaan. Heeft de schuldeiser het luchtvaartuig niet binnen deze termijn verkocht, dan kan de curator het luchtvaartuig verkopen. De rechter-commissaris is bevoegd de termijn op verzoek van de schuldeiser een of meer malen te verlengen.
Op verkoop door de curator zijn de artikelen 584d en 584f-584q van het Wetboek van Burgerlijke Rechtsvordering van overeenkomstige toepassing, met dien verstande dat de curator wordt aangemerkt als beslaglegger uit hoofde van een vordering die niet van enige voorrang is voorzien, en dat met het vonnis van faillietverklaring wordt gehandeld als voorgeschreven voor het proces-verbaal van beslag.
De rechter-commissaris in het faillissement kan in dat geval bepalen dat een door hem vast te stellen gedeelte van de algemene faillissementskosten als kosten van de executie in de zin van artikel 584n van het Wetboek van Burgerlijke Rechtsvordering zal gelden.
De curator kan het luchtvaartuig tot op het tijdstip van de verkoop lossen tegen voldoening van het daarop verschuldigde, alsmede van de reeds gemaakte kosten van executie.
Artikel 59 is van overeenkomstige toepassing.
