Article 45

In the event of prejudice caused by a gratuitous juridical act, which the debtor has performed within one year prior to the declaration of bankruptcy, it is presumed that he knew or ought to have known that prejudice to the creditors would be the consequence of the juridical act.
In geval van benadeling door een rechtshandeling om niet, die de schuldenaar heeft verricht binnen één jaar vóór de faillietverklaring, wordt vermoed dat hij wist of behoorde te weten dat benadeling van de schuldeisers het gevolg van de rechtshandeling zou zijn.
