If a petition for a declaration of bankruptcy and a petition to pronounce the application of the debt restructuring scheme (schuldsaneringsregeling) referred to in Title III are pending simultaneously, the latter shall be considered first.
The consideration of the petition for a declaration of bankruptcy is suspended until, by a judgment that has become final and conclusive, a decision has been made on the petition for the pronouncement of the application of the debt restructuring scheme (schuldsaneringsregeling).
The petition for a declaration of bankruptcy lapses by operation of law upon the judgment for the definitive application of the debt restructuring scheme (schuldsaneringsregeling).
Indien een verzoek tot faillietverklaring en een verzoek tot het uitspreken van de toepassing van de schuldsaneringsregeling bedoeld in titel III gelijktijdig aanhangig zijn, komt eerst het laatste in behandeling.
De behandeling van het verzoek tot faillietverklaring wordt geschorst totdat bij in kracht van gewijsde gegane uitspraak is beslist op het verzoek tot het uitspreken van de toepassing van de schuldsaneringsregeling.
Het verzoek tot faillietverklaring vervalt van rechtswege door de uitspraak tot de definitieve toepassing van de schuldsaneringsregeling.
