With regard to a life insurance contract, the following furthermore fall outside the estate:

a.

the right to have a life insurance policy surrendered insofar as the beneficiary or the policyholder is unreasonably prejudiced by the surrender;

b.

the right to change the designation of beneficiary, unless the change is made for the benefit of the estate and the beneficiary or the policyholder is not unreasonably prejudiced thereby;

c.

the right to borrow against the insurance.

For the exercise of the right to effect the surrender and the right to change the beneficiary designation, the bankruptcy trustee requires the consent of the supervisory judge, who, if necessary, determines up to what amount these rights may be exercised. Only with the written consent of the policyholder is the bankruptcy trustee authorized to transfer the insurance.

If the bankruptcy trustee has altered the designation of beneficiary, this alteration lapses upon the termination of the bankruptcy.

If the beneficiary designation becomes irrevocable after the declaration of bankruptcy, this irrevocability cannot be invoked against the estate. The insurer is obliged to retain a payment to which the beneficiary designation relates. Insofar as it is established that the beneficiary designation will not be amended, the first and second sentences shall not apply. With regard to the beneficiary, Article 69 applies mutatis mutandis.

Notwithstanding the second sentence of paragraph 4, the insurer may invoke a payment to the beneficiary against the estate, to the extent that the trustee in bankruptcy does not prove that, at the time of payment, the insurer was aware of the bankruptcy or of a prior attachment against the policyholder. In that case, the trustee in bankruptcy has recourse against the beneficiary.

Ten aanzien van een overeenkomst van levensverzekering vallen voorts buiten de boedel:

a.

het recht op het doen afkopen van een levensverzekering voorzover de begunstigde of de verzekeringnemer door afkoop onredelijk benadeeld wordt;

b.

het recht om de begunstiging te wijzigen, tenzij de wijziging geschiedt ten behoeve van de boedel en de begunstigde of de verzekeringnemer daardoor niet onredelijk benadeeld wordt;

c.

het recht om de verzekering te belenen.

Voor de uitoefening van het recht op het doen afkopen en het recht om de begunstiging te wijzigen, behoeft de curator de toestemming van de rechter-commissaris, die daarbij zonodig vaststelt tot welk bedrag deze rechten mogen worden uitgeoefend. Slechts met schriftelijke toestemming van de verzekeringnemer is de curator bevoegd tot overdracht van de verzekering.

Indien de curator de begunstiging heeft gewijzigd, vervalt deze wijziging met de beëindiging van het faillissement.

Indien de begunstiging na de faillietverklaring onherroepelijk wordt, kan deze onherroepelijkheid niet aan de boedel worden tegengeworpen. De verzekeraar is verplicht een uitkering, waarop de begunstiging betrekking heeft, onder zich te houden. Voor zover vaststaat dat de begunstiging niet zal worden gewijzigd, blijven de eerste en de tweede volzin buiten toepassing. Ten aanzien van de begunstigde is artikel 69 van overeenkomstige toepassing.

In afwijking van het vierde lid, tweede zin, kan de verzekeraar een betaling aan de begunstigde tegenwerpen aan de boedel, voorzover de curator niet bewijst dat de verzekeraar op het tijdstip van betaling op de hoogte was van het faillissement of van een daaraan voorafgegaan beslag ten laste van de verzekeringnemer. In dat geval heeft de curator verhaal op de begunstigde.
