If the person who is both a creditor and a debtor of the insurer is entitled to set off his debt against the claim against the insurer under the law applicable to the claim of the insurer, the decision to open the liquidation proceedings shall leave the said right unaffected.
Indien degene die zowel schuldeiser als schuldenaar is van de verzekeraar bevoegd is zijn schuld te verrekenen met de vordering op de verzekeraar op grond van het recht dat van toepassing is op de vordering van de verzekeraar, laat de beslissing tot opening van de liquidatieprocedure de bedoelde bevoegdheid onverlet.
