Article 213me

The curator requests permission to make a payment as referred to in Article 213ma to, for the benefit of:
natural persons; and
legal persons which, at the time the claim becomes due and payable, operate a micro-undertaking or small undertaking as referred to in Article 3, paragraph 1 and paragraph 2 respectively, of Directive 2013/23/EU of the European Parliament and of the Council of 26 June 2013 on the annual financial statements, consolidated financial statements and related reports of certain types of undertakings, amending Directive 2006/43/EC of the European Parliament and of the Council and repealing Council Directives 78/660/EEC and 83/349/EEC.
The bankruptcy trustee makes a distribution to a creditor who is not a person as referred to in the first paragraph if the supervisory judge so decides upon the petition of that creditor or an interested party. The supervisory judge so decides if making a distribution only after the verification meeting would have unacceptable consequences according to standards of reasonableness and fairness.
De curator vraagt toestemming voor het doen van een uitkering als bedoeld in artikel 213ma aan ten behoeve van:
natuurlijke personen; en
rechtspersonen die op het tijdstip dat de vordering opeisbaar wordt een micro-onderneming of kleine onderneming drijven als bedoeld in artikel 3, eerste onderscheidenlijk tweede lid van de richtlijn 2013/23/EU van het Europees Parlement en van de Raad van 26 juni 2013 betreffende de jaarlijkse financiële overzichten, geconsolideerde financiële overzichten en aanverwante verslagen van bepaalde ondernemingsvormen, tot wijziging van Richtlijn 2006/43/EG van het Europees Parlement en de Raad en tot intrekking van Richtlijnen 78/660/EEG en 83/349/EEG van de Raad.
De curator doet aan een schuldeiser die niet een persoon is als bedoeld in het eerste lid een uitkering indien de rechter-commissaris op verzoek van die schuldeiser of een belanghebbende daartoe beslist. De rechter-commissaris beslist daartoe indien het eerst na de verificatievergadering doen van een uitkering naar maatstaven van redelijkheid en billijkheid onaanvaardbare gevolgen zou hebben.
