Article 153

On the same day, or otherwise as soon as possible, the court gives its reasoned order.
It shall refuse the homologation:
if the assets of the estate substantially exceed the sum stipulated in the agreement;
if the performance of the agreement is not sufficiently guaranteed;
if the composition has been brought about by fraud, by the favouring of one or more creditors or with the aid of other unfair means, irrespective of whether the bankrupt or another person has cooperated therein.
It may also refuse the homologation on other grounds and also of its own motion.
Op dezelfde dag, of anders zo spoedig mogelijk, geeft de rechtbank haar met redenen omklede beschikking.
Zij zal de homologatie weigeren:
indien de baten des boedels, de som, bij het akkoord bedongen, aanmerkelijk te boven gaan;
indien de nakoming van het akkoord niet voldoende is gewaarborgd;
indien het akkoord door bedrog, door begunstiging van een of meer schuldeisers of met behulp van andere oneerlijke middelen is tot stand gekomen, onverschillig of de gefailleerde dan wel een ander daartoe heeft medegewerkt.
Zij kan ook op andere gronden en ook ambtshalve de homologatie weigeren.
