The amounts of the fees referred to in Article 38 and the proportion referred to in Article 39 shall be fixed at such a level as to ensure that the revenue in respect thereof is sufficient for the budget of the Organisation to be balanced.
However, if the Organisation is unable to balance its budget under the conditions laid down in paragraph 1, the Contracting States shall remit to the Organisation special financial contributions, the amount of which shall be determined by the Administrative Council for the accounting period in question.
These special financial contributions shall be determined in respect of any Contracting State on the basis of the number of patent applications filed in the last year but one prior to that of entry into force of this Convention, and calculated in the following manner:
one half in proportion to the number of patent applications filed in that Contracting State;
one half in proportion to the second highest number of patent applications filed in the other Contracting States by natural or legal persons having their residence or principal place of business in that Contracting State.
However, the amounts to be contributed by States in which the number of patent applications filed exceeds 25 000 shall then be taken as a whole and a new scale drawn up in proportion to the total number of patent applications filed in these States.
Where the scale position of any Contracting State cannot be established in accordance with paragraph 3, the Administrative Council shall, with the consent of that State, decide its scale position.
Article 39, paragraphs 3 and 4, shall apply mutatis mutandis to the special financial contributions.
The special financial contributions shall be repaid with interest at a rate which shall be the same for all Contracting States. Repayments shall be made in so far as it is possible to provide for this purpose in the budget; the amount thus provided shall be distributed among the Contracting States in accordance with the scale referred to in paragraphs 3 and 4.
The special financial contributions remitted in any accounting period shall be repaid in full before any such contributions or parts thereof remitted in any subsequent accounting period are repaid.
De hoogte van de taksen, bedoeld in artikel 38, en het percentage bedoeld in artikel 39, dient zodanig te worden vastgesteld dat de daaruit voortvloeiende inkomsten volstaan voor een sluitende begroting van de Organisatie.
Indien de Organisatie echter niet in staat is de begroting sluitend te maken op de wijze als bedoeld in het eerste lid, betalen de Verdragsluitende Staten aan de Organisatie bijzondere financiële bijdragen waarvan de hoogte door de Raad van Bestuur wordt vastgesteld voor het desbetreffende begrotingsjaar.
De bijzondere financiële bijdragen worden voor elke Verdragsluitende Staat vastgesteld op grond van het aantal octrooiaanvragen ingediend in het voorlaatste jaar vóór de inwerkingtreding van dit Verdrag, en met behulp van de volgende verdeelsleutel:
voor de helft in verhouding tot het aantal in de betrokken Verdragsluitende Staat ingediende octrooiaanvragen;
voor de helft in verhouding tot het op één na hoogste aantal octrooiaanvragen die door natuurlijke personen of rechtspersonen die hun woonplaats of zetel in de betrokken Verdragsluitende Staat hebben, in de andere Verdragsluitende Staten zijn ingediend.
De bedragen die dienen te worden betaald door de Staten waarin meer dan 25.000 octrooiaanvragen zijn ingediend, worden echter samen genomen en opnieuw verdeeld in verhouding tot het totale aantal in die Staten ingediende octrooiaanvragen.
Wanneer de hoogte van de bijdrage in een Verdragsluitende Staat niet kan worden vastgesteld overeenkomstig het bepaalde in het derde lid, stelt de Raad van Bestuur met instemming van de betrokken Staat de bijdrage vast.
Artikel 39, derde en vierde lid, is van overeenkomstige toepassing op de bijzondere financiële bijdragen.
De bijzondere financiële bijdragen worden terugbetaald met een rentepercentage dat voor alle Verdragsluitende Staten gelijk is. De terugbetalingen geschieden voor zover op de begroting daartoe middelen kunnen worden vrijgemaakt; het aldus beschikbare bedrag wordt onder de Verdragsluitende Staten verdeeld met behulp van de in het derde en vierde lid van dit artikel bedoelde verdeelsleutel.
De bijzondere financiële bijdragen die zijn betaald in de loop van een bepaald begrotingsjaar dienen geheel te zijn terugbetaald voordat een in een later begrotingsjaar betaalde bijzondere bijdrage geheel of gedeeltelijk wordt terugbetaald.
