Article 1665

When one of the partners, for his own account, has a claim for a due and payable sum from a person who also owes a similarly due and payable sum to the partnership (maatschap), the payment which he receives must be imputed to the claim of the partnership and to his own claim, in proportion to both those claims, even if he, upon discharge, might have applied everything in reduction or satisfaction of his own claim; but if he has stipulated upon discharge that the entire payment would be applied to the claim of the partnership, this stipulation shall be observed.
Wanneer een der vennooten, voor zijne eigene rekening, eene opeischbare som te vorderen heeft van iemand die mede eene insgelijks opeischbare som verschuldigd is aan de maatschap, moet de betaling, welke hij ontvangt, op de inschuld der maatschap en op die van hemzelven, naar evenredigheid van beide die vorderingen, toegerekend worden, al ware het ook dat hij, bij de kwijting, alles in mindering of voldoening van zijne eigene inschuld mogt gebragt hebben; maar indien hij bij de kwijting bepaald heeft dat de geheele betaling zoude strekken voor de inschuld der maatschap, zal deze bepaling worden nagekomen.
