Article 7:504

The package travel contract shall be drafted in plain and intelligible language and, in so far as it is in writing, shall be legible. At the conclusion of the package travel contract or without delay thereafter, the organiser or the retailer shall provide the traveller with a copy or a confirmation of the contract on a durable medium. If the package travel contract has been concluded in the simultaneous physical presence of the parties, the traveller is entitled to a paper copy.
By way of derogation from paragraph 1, in the case of contracts concluded off-premises within the meaning of Article 230g, paragraph 1, subparagraph f of Book 6, the organiser shall provide the traveller with a copy or confirmation of the package travel contract on paper or, if the traveller agrees, on another durable medium.
The package travel contract or the confirmation thereof shall contain the full content of the agreement, including all information referred to in Article 502, paragraph 1, subparagraphs (a) to (h) inclusive, as well as the following information:
special requests of the traveller which have been accepted by the organiser;
the fact that the organiser:
is liable for the proper performance of all travel services included in the contract, in accordance with Article 510;
is obliged to provide assistance when the traveller is in distress, in accordance with Article 513;
the name and the contact details, including the geographical address, of the body responsible for insolvency protection;
the name, address, telephone number, e-mail address and, where applicable, the fax number of the organiser’s local representative, of a contact point or of another service;
the notification that the traveller is obliged, in accordance with Article 510, paragraph 2, to report any non-conformity detected during the performance of the package travel;
if minors, who are not accompanied by a parent or another authorised person, travel on the basis of a package travel contract which includes accommodation, information on the basis of which direct contact can be established with the minor or with the person responsible for the minor at the minor's place of residence;
information on available internal complaint-handling procedures and on alternative dispute resolution mechanisms in accordance with the Implementation Act on out-of-court consumer dispute resolution (Implementatiewet buitengerechtelijke geschillenbeslechting consumenten) and, where applicable, on the alternative dispute resolution entity by which the trader is covered and on the online dispute resolution platform in accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (OJ L 165);
information regarding the right of the traveller to transfer his agreement to another traveller in accordance with Article 506.
With regard to package travels as referred to in Article 500, paragraph (b), sub (ii), 5°, the trader to whom the data are transmitted shall inform the organiser of the conclusion of the contract leading to the creation of a package travel. The trader shall provide the organiser with the information necessary to comply with his obligations as an organiser. As soon as the organiser is informed that a package travel has been created, the organiser shall provide the traveller with the information referred to in paragraph 3, parts (a) to (h) inclusive, on a durable medium.
The information referred to in paragraphs 3 and 4 shall be provided in a clear, understandable and conspicuous manner.
In good time before the start of the package travel, the organiser shall provide the traveller with the necessary receipts, vouchers and tickets, information on the scheduled departure times and, where applicable, on the deadline for check-in, as well as the scheduled times for intermediate stops, transport connections and arrival.
De pakketreisovereenkomst is in heldere en begrijpelijke taal opgesteld en, voor zover zij schriftelijk wordt vastgelegd, leesbaar. Bij het sluiten van de pakketreisovereenkomst of onverwijld daarna, verstrekt de organisator of de doorverkoper de reiziger een kopie of een bevestiging van de overeenkomst op een duurzame gegevensdrager. Als de pakketreisovereenkomst in de gelijktijdige fysieke aanwezigheid van partijen is gesloten, heeft de reiziger recht op een papieren kopie.
In afwijking van lid 1 verstrekt de organisator bij buiten verkoopruimten gesloten overeenkomsten in de zin van artikel 230g, lid 1, onderdeel f van Boek 6, een kopie of bevestiging van de pakketreisovereenkomst aan de reiziger op papier of, als de reiziger hiermee instemt, op een andere duurzame gegevensdrager.
De pakketreisovereenkomst of bevestiging ervan bevat de volledige inhoud van de overeenkomst, met inbegrip van alle in artikel 502, lid 1, onderdelen a tot en met h, bedoelde informatie, alsmede de volgende informatie:
bijzondere wensen van de reiziger waarop de organisator is ingegaan;
het feit dat de organisator:
aansprakelijk is voor de goede uitvoering van alle onder de overeenkomst vallende reisdiensten, in overeenstemming met artikel 510;
verplicht is bijstand te bieden wanneer de reiziger in moeilijkheden verkeert, in overeenstemming met artikel 513;
de naam en de contactgegevens, met inbegrip van het geografische adres, van de instantie die instaat voor de bescherming bij insolventie;
de naam, het adres, het telefoonnummer, het e-mailadres en, in voorkomend geval, het faxnummer van de lokale vertegenwoordiger van de organisator, van een contactpunt of van een andere dienst;
de mededeling dat de reiziger overeenkomstig artikel 510, lid 2, verplicht is eventuele tijdens de uitvoering van de pakketreis geconstateerde non-conformiteit te melden;
indien minderjarigen die niet door een ouder of een andere gemachtigde persoon vergezeld worden, op basis van een pakketreisovereenkomst reizen waarin accommodatie is begrepen, informatie op basis waarvan rechtstreeks contact kan worden opgenomen met de minderjarige of met de persoon die op de verblijfplaats van de minderjarige voor de minderjarige verantwoordelijk is;
informatie over beschikbare interne procedures voor klachtenafhandeling en over alternatieve geschillenbeslechtingsmechanismen overeenkomstig de Implementatiewet buitengerechtelijke geschillenbeslechting consumenten en in voorkomend geval, over de alternatieve geschillenbeslechtingsinstantie waaronder de handelaar valt en over het platform voor onlinegeschillenbeslechting overeenkomstig Verordening (EU) nr. 524/2013 van het Europees Parlement en de Raad van 21 mei 2013 betreffende onlinebeslechting van consumentengeschillen en tot wijziging van Verordening (EG) nr. 2006/2004 en Richtlijn 2009/22/EG (PbEU, L 165);
informatie over het recht van de reiziger om zijn overeenkomst overeenkomstig artikel 506 aan een andere reiziger over te dragen.
Met betrekking tot pakketreizen als bedoeld in artikel 500, onderdeel b, onder ii), 5°, informeert de handelaar aan wie de gegevens worden toegezonden, de organisator over de sluiting van de overeenkomst die tot de totstandbrenging van een pakketreis leidt. De handelaar verschaft de organisator de informatie die nodig is om aan zijn verplichtingen als organisator te voldoen. Zodra de organisator ervan in kennis is gesteld dat een pakketreis tot stand is gebracht, verstrekt de organisator aan de reiziger de in lid 3, onderdelen a tot en met h bedoelde informatie op een duurzame gegevensdrager.
De in lid 3 en 4 bedoelde informatie wordt op een duidelijke, begrijpelijke en in het oog springende manier verstrekt.
Tijdig voor het begin van de pakketreis verstrekt de organisator de reiziger de nodige ontvangstbewijzen, vouchers en vervoerbewijzen, informatie over de geplande vertrektijden en, in voorkomend geval, over de uiterste tijd om in te checken, en de geplande tijden van tussenstops, aansluitingen en aankomst.
