When the choice belongs to one of the parties, the power to choose passes to the other party if the latter has set a reasonable period for its counterparty to determine its choice and the counterparty has not made its choice within that period.
The power to choose, however, does not pass to the creditor before the latter has the right to demand performance, nor to the debtor before the latter has the right to perform.
If a right of pledge or an attachment rests upon the claim and the commenced enforcement cannot be continued in the absence of a choice, the pledgee or the person who has levied the attachment may set a reasonable period for both parties to exercise a choice in accordance with their mutual legal relationship. If the choice is not made within this period, the power to choose shall pass to the pledgee or the person who has levied the attachment. They are bound not to exercise this power needlessly.
Wanneer de keuze aan een der partijen toekomt, gaat de bevoegdheid om te kiezen op de andere partij over, indien deze haar wederpartij een redelijke termijn heeft gesteld tot bepaling van haar keuze en deze daarbinnen haar keuze niet heeft uitgebracht.
De bevoegdheid om te kiezen gaat echter niet over op de schuldeiser voordat deze het recht heeft om nakoming te vorderen, noch op de schuldenaar voordat deze het recht heeft om te voldoen.
Indien op de vordering een pandrecht of een beslag rust en de aangevangen executie bij gebreke van een keuze niet kan worden voortgezet, kan de pandhouder of de beslaglegger aan beide partijen een redelijke termijn stellen om overeenkomstig hun onderlinge rechtsverhouding een keuze uit te brengen. Indien de keuze niet binnen deze termijn geschiedt, gaat de bevoegdheid tot kiezen op de pandhouder of beslaglegger over. Zij zijn gehouden niet nodeloos van deze bevoegdheid gebruik te maken.
