The surety and the person whose property is encumbered for the debt of another may invoke the suspension of their liability to the extent that the creditor is authorised to set off his claim against an exigible debt to the debtor.
They may invoke the release from their liability to the extent that the creditor has caused a right of set-off against a debt to the debtor to be lost, unless the creditor had a reasonable ground for doing so or is not at fault.
De borg en degene wiens goed voor de schuld van een ander verbonden is, kunnen de opschorting van hun aansprakelijkheid inroepen, voor zover de schuldeiser bevoegd is zijn vordering met een opeisbare schuld aan de schuldenaar te verrekenen.
Zij kunnen de bevrijding van hun aansprakelijkheid inroepen, voor zover de schuldeiser een bevoegdheid tot verrekening met een schuld aan de schuldenaar heeft doen verloren gaan, tenzij hij daartoe een redelijke grond had of hem geen schuld treft.
