Article 4:170

If the assets subject to the administration (bewind) or encumbered with a limited right subject to the administration belong to a community, the administrator is authorised to demand division and, with the consent of the entitled person, is authorised to enter into an agreement to exclude division for a specific period of time.
The administrator is, with the consent of the person entitled, authorised to cooperate in the division.
Paragraphs 2 and 3 of Article 169 shall apply mutatis mutandis.
Behoren de goederen die onder het bewind staan of die met een onder het bewind staand beperkt recht zijn belast tot een gemeenschap, dan is de bewindvoerder bevoegd tot het vorderen van verdeling en is hij, met toestemming van de rechthebbende, bevoegd tot het aangaan van een overeenkomst tot uitsluiting van verdeling voor een bepaalde tijd.
De bewindvoerder is met toestemming van de rechthebbende bevoegd tot medewerking aan de verdeling.
De leden 2 en 3 van artikel 169 zijn van overeenkomstige toepassing.
