If all acquiring companies are formed upon the division and the dividing legal person becomes the sole shareholder thereof upon the division, Articles 334f paragraph 4 first sentence, 334w and 334y up to and including 334aa shall not apply.
If all acquiring companies are incorporated upon the division and the shareholders of the dividing company become shareholders thereof in proportion to their shareholding in the dividing company, Articles 334g, 334i and 334y up to and including 334bb shall not apply.
Indien alle verkrijgende vennootschappen bij de splitsing worden opgericht en de splitsende rechtspersoon daarvan bij de splitsing enig aandeelhouder wordt, zijn de artikelen 334f lid 4 eerste zin, 334w en 334y tot en met 334aa niet van toepassing.
Indien alle verkrijgende vennootschappen bij de splitsing worden opgericht en de aandeelhouders van de splitsende vennootschap daarvan, evenredig aan hun aandeel in de splitsende vennootschap, aandeelhouder worden, zijn de artikelen 334g, 334i en 334y tot en met 334bb niet van toepassing.
