Articles 63f up to and including 63j shall not apply to a legal person whose activities are exclusively or almost exclusively limited to the management and financing of dependent companies and of its and their participations in other legal persons, provided that the employees of the Dutch dependent companies are represented in a works council which possesses the powers referred to in Articles 158 and 268.
Our Minister of Justice may, having heard the Social and Economic Council, grant a cooperative or a mutual insurance society, upon its petition, an exemption from one or more of Articles 63f to 63j inclusive. The exemption may be granted subject to restrictions and conditions may be attached thereto. It may be amended and revoked.
De artikelen 63f tot en met 63j gelden niet voor een rechtspersoon wier werkzaamheid zich uitsluitend of nagenoeg uitsluitend beperkt tot het beheer en de financiering van afhankelijke maatschappijen en van haar en hun deelnemingen in andere rechtspersonen, mits de werknemers van de Nederlandse afhankelijke maatschappijen vertegenwoordigd zijn in een ondernemingsraad die de bevoegdheden heeft, bedoeld in de artikelen 158 en 268.
Onze Minister van Justitie kan, gehoord de Sociaal-Economische Raad, aan een coöperatie of onderlinge waarborgmaatschappij op haar verzoek ontheffing verlenen van een of meer der artikelen 63f tot en met 63j. De ontheffing kan onder beperkingen worden verleend en daaraan kunnen voorschriften worden verbonden. Zij kan worden gewijzigd en ingetrokken.
