Subject to paragraph 2, Dutch law is applicable to an adoption to be pronounced in the Netherlands.
The law of the state whose nationality the child possesses is applicable to the consent or the consultation or the provision of information of the parents of the child or of other persons or institutions. If the child possesses the nationality of more than one state, the law under which consent or consultation or provision of information is required is applicable. If the child possesses Dutch nationality, Dutch law is applicable, regardless of whether the child possesses another nationality in addition to Dutch nationality.
If the law applicable pursuant to paragraph 2 to the consent, or consultation or provision of information, does not provide for adoption, Dutch law shall apply. The law applicable pursuant to this paragraph also determines whether, in the absence of consent, such consent may be replaced by a judicial decision.
Dutch law applies to the revocation of an adoption pronounced in the Netherlands.
Op een in Nederland uit te spreken adoptie is, behoudens lid 2, het Nederlandse recht van toepassing.
Op de toestemming dan wel de raadpleging of de voorlichting van de ouders van het kind of van andere personen of instellingen is toepasselijk het recht van de staat waarvan het kind de nationaliteit bezit. Bezit het kind de nationaliteit van meer dan een staat, dan is toepasselijk het recht volgens hetwelk toestemming dan wel raadpleging of voorlichting vereist is. Bezit het kind de Nederlandse nationaliteit, dan is het Nederlandse recht van toepassing, ongeacht of het kind naast de Nederlandse nationaliteit nog een andere nationaliteit bezit.
Indien het ingevolge lid 2 op de toestemming dan wel raadpleging of voorlichting toepasselijke recht de adoptie niet kent, is het Nederlandse recht van toepassing. Het ingevolge dit lid toepasselijke recht bepaalt tevens of bij gebreke van toestemming deze kan worden vervangen door een rechterlijke beslissing.
Op de herroeping van een in Nederland uitgesproken adoptie is het Nederlandse recht van toepassing.
