The task of the mentor ends:
upon the termination of the mentorship;
by lapse of time, if he was appointed for a specific period;
by death;
by his being placed under guardianship (ondercuratelestelling) or by the establishment of a mentorship (mentorschap) for his benefit;
by dismissal granted to him by the subdistrict court (kantonrechter) with effect from a day determined by said court.
The discharge shall be granted to him either at his own request, or for compelling reasons, or because he no longer meets the requirements to become a mentor, such being at the petition of the co-mentor or the person entitled to petition for mentorship as referred to in Article 451, paragraphs 1 and 2, or ex officio. Pending the investigation, the subdistrict court may make provisional arrangements in the mentorship and suspend the mentor. The subdistrict court may, if necessary, proceed to do so without having previously heard the mentor. In that case, the order shall lose its force after the expiry of two weeks, unless the mentor has been given the opportunity to be heard within this period.
A former mentor remains obliged to do everything that cannot be postponed without prejudice to the person concerned, until such time as a person is again authorised in respect of the matters referred to in Article 453, paragraph 1, of this Book. In the cases mentioned in the first paragraph, under (d), this obligation rests upon his curator or mentor, provided that the latter is aware of the mentorship.
Article 384 of this Book shall apply mutatis mutandis.
De taak van de mentor eindigt:
bij het einde van het mentorschap;
door tijdsverloop, indien hij voor een bepaalde tijd was benoemd;
door zijn dood;
door zijn ondercuratelestelling of door instelling van een mentorschap te zijnen behoeve;
door ontslag dat hem door de kantonrechter met ingang van een door deze bepaalde dag wordt verleend.
Het ontslag wordt hem verleend hetzij op eigen verzoek, hetzij wegens gewichtige redenen of omdat hij niet meer voldoet aan de eisen om mentor te kunnen worden, zulks op verzoek van de medementor of degene die gerechtigd is mentorschap te verzoeken als bedoeld in artikel 451, eerste en tweede lid, dan wel ambtshalve. Hangende het onderzoek kan de kantonrechter voorlopige voorzieningen in het mentorschap treffen en de mentor schorsen. De kantonrechter kan hiertoe zo nodig ook zonder de mentor tevoren te hebben gehoord overgaan. In dat geval verliest de beschikking haar kracht na verloop van twee weken, tenzij de mentor binnen deze termijn in de gelegenheid is gesteld om te worden gehoord.
Een gewezen mentor blijft verplicht al datgene te doen, wat niet zonder nadeel voor de betrokkene kan worden uitgesteld, totdat wederom een persoon bevoegd is ten aanzien van de aangelegenheden bedoeld in artikel 453, eerste lid, van dit boek. In de gevallen genoemd in het eerste lid, onder d, rust deze verplichting op diens curator of mentor, indien deze van het mentorschap kennis draagt.
Artikel 384 van dit boek is van overeenkomstige toepassing.
