Article 1:399

The court may mitigate the obligation of blood relatives and relatives by affinity to provide maintenance on the grounds of such conduct by the person entitled to maintenance that the provision of maintenance cannot reasonably be required, or cannot be required in full; without prejudice to the provisions of the following section regarding the provision for the costs of care and upbringing of minor children and stepchildren.
De rechter kan de verplichting van bloed- en aanverwanten tot levensonderhoud matigen op grond van zodanige gedragingen van de tot onderhoud gerechtigde, dat verstrekking van levensonderhoud naar redelijkheid niet of niet ten volle kan worden gevergd; onverminderd hetgeen in de volgende afdeling is bepaald omtrent de voorziening in de kosten van de verzorging en opvoeding van minderjarige kinderen en stiefkinderen.
