Public registers shall be kept at the courts, or at such other place or places as may be designated by administrative decree (algemene maatregel van bestuur), in which records are maintained of legal facts relating to the authority exercised over minors.

By administrative order (algemene maatregel van bestuur) it shall be determined which legal facts are to be recorded, the manner in which such recording takes place, and the manner in which the provision of recorded data is carried out.

Law of Persons and Family Law. Can the granting of substitute consent for the recognition of a child (Article 1:204 paragraph 3 of the Civil Code) be combined in a single procedure with the awarding of custody over that child (Article 1:253c paragraphs 2-4 of the Civil Code)?

Family law. Act on the promotion of continued parenthood and careful separation. Contact arrangement between parent and child. Habitual residence of the child. Transitional law. Termination of cohabitation of unmarried parents whose authority has been registered in the authority register referred to in Article 1:244 of the Civil Code pursuant to Article 1:252, paragraph 1, of the Civil Code. New procedural requirements do not apply to petitions filed before the date of entry into force of the Act. The stay of proceedings provided for in Article 1:253a, paragraph 3, of the Civil Code is a new procedural requirement. The court is not required, in connection with the entry into force of this Act, to invariably assume an equal division of the habitual residence of the child and an equal division of the care and upbringing tasks between both parents. The principle of equality between both parents adopted by the legislature does not imply that, in deciding on the habitual residence of a minor child and the division of care and upbringing tasks, the best interests of the minor child should not carry the greatest weight. The equality of parents laid down in Article 1:247 of the Civil Code does not mandate an equal (50%-50%) division of the time the child spends with each parent.

Dispute between an unmarried father and mother regarding joint custody over their minor child; does inadmissibility on the basis of Article 1:252 of the Civil Code (Burgerlijk Wetboek) constitute an impermissible restriction of the right of access to a court guaranteed to the father by Article 6(1) ECHR for the determination of his right to ‘the exercise of parental rights’ derived from Article 8(1) ECHR?; interpretation of Article 1:253c(1) and Article 1:253e of the Civil Code; the Supreme Court (Hoge Raad) does not depart from HR 27 May 2005, R04/088, NJ 2005, 485.
