The father of a child is the man:

a.

who, at the time of the birth of the child, is married to, or has entered into a registered partnership with, the woman from whom the child is born, unless part b or the final sentence of Article 198, paragraph 1, under b, applies;

b.

whose marriage or registered partnership with the woman from whom the child was born was dissolved by his death within 306 days before the birth of the child, even if the mother had remarried or had registered a new partnership; if, however, the woman was legally separated (gescheiden van tafel en bed) since the 306th day before the birth of the child or she and her spouse or registered partner have lived apart since that time, the woman may declare before the Registrar of Civil Status within one year after the birth of the child that her deceased spouse or registered partner is not the father of the child, of which declaration a deed shall be drawn up; if the mother had remarried or had registered a new partnership at the time of the birth, then in that case the current spouse or registered partner is the father or, in the case referred to in Article 198, paragraph 1, under b, the current spouse or registered partner is the mother of the child;

c.

who has acknowledged the child;

d.

whose paternity has been judicially established; or

e.

who has adopted the child.

Vader van een kind is de man:

a.

die op het tijdstip van de geboorte van het kind met de vrouw uit wie het kind is geboren, is gehuwd of een geregistreerd partnerschap is aangegaan, tenzij onderdeel b of de slotzin van artikel 198, eerste lid, onder b, geldt;

b.

wiens huwelijk of geregistreerd partnerschap met de vrouw uit wie het kind is geboren, binnen 306 dagen voor de geboorte van het kind door zijn dood is ontbonden, zelfs indien de moeder was hertrouwd of een nieuw partnerschap had laten registreren; indien echter de vrouw sedert de 306de dag voor de geboorte van het kind was gescheiden van tafel en bed of zij en haar echtgenoot of geregistreerde partner sedert dat tijdstip gescheiden hebben geleefd, kan de vrouw binnen een jaar na de geboorte van het kind ten overstaan van de ambtenaar van de burgerlijke stand verklaren dat haar overleden echtgenoot of geregistreerde partner niet de vader is van het kind, van welke verklaring een akte wordt opgemaakt; was de moeder op het tijdstip van de geboorte hertrouwd of had zij een nieuw partnerschap laten registreren dan is in dat geval de huidige echtgenoot of geregistreerde partner de vader of, in het geval, genoemd in artikel 198, eerste lid, onder b, de huidige echtgenote of geregistreerde partner de moeder van het kind;

c.

die het kind heeft erkend;

d.

wiens vaderschap gerechtelijk is vastgesteld; of

e.

die het kind heeft geadopteerd.
