Article 2.19
in forceASSIGNMENT, LICENCE AND OTHER RIGHTS
Without prejudice to the proprietor of a well-known trademark within the meaning of Article 6bis of the Paris Convention, no person may, regardless of the claim they institute, invoke legal protection for a sign that is considered a trademark within the meaning of Article 2.1, unless they can rely on a registration of the trademark for which they have applied.
Where applicable, the court shall declare the petition inadmissible of its own motion.
The provisions of this Title shall be without prejudice to the right of users of a sign, which is not considered a trademark within the meaning of Article 2.1, to invoke the provisions of common law insofar as this allows for opposition to the unlawful use of such sign.
