Without prejudice to the provisions of Article 3.7, paragraph 2, the exclusive right to a design or model shall lapse:
by voluntary cancellation or by the expiry of the validity period of the registration of the Benelux filing;
by the expiry of the validity period of the registration of the international deposit or by renunciation of rights which, for the Benelux territory, arise from the international deposit, or by ex officio cancellation of the international deposit as referred to in Article 6, paragraph 4, under c, of the Hague Agreement.
Behoudens het bepaalde in artikel 3.7, lid 2, vervalt het uitsluitend recht op een tekening of model:
door vrijwillige doorhaling of door het verstrijken van de geldigheidsduur van de inschrijving van het Benelux-depot;
door het verstrijken van de geldigheidsduur van de inschrijving van het internationaal depot of door afstand van rechten, die voor het Benelux-gebied uit het internationaal depot voortvloeien of door ambtshalve doorhaling van het internationaal depot, bedoeld in artikel 6, vierde lid, onder c, van de Overeenkomst van 's-Gravenhage.
