The holder of the registration of a Benelux filing may at any time request the cancellation of this registration, unless there are rights of third parties which have been established by agreement or are being pursued in legal proceedings and which have been brought to the notice of the Office.
In the case of a multiple deposit, the cancellation may relate to a part of the designs or models contained in that deposit.
If a licence has been registered, the cancellation of the registration of the design or model may only be effected upon the joint petition of the holder of the registration and the licensee. The provisions of the preceding sentence shall apply mutatis mutandis in the event that a right of pledge or an attachment has been registered.
The cancellation applies to the entire Benelux territory, notwithstanding any declaration to the contrary.
The provisions included in this article shall apply mutatis mutandis to the renunciation of the protection resulting from an international registration for the Benelux territory.
De houder van de inschrijving van een Benelux-depot kan te allen tijde de doorhaling van deze inschrijving verzoeken, behalve indien er rechten van derden bestaan, die bij overeenkomst zijn vastgelegd of in rechte worden vervolgd en welke ter kennis van het Bureau zijn gebracht.
Indien het een meervoudig depot betreft, kan de doorhaling betrekking hebben op een deel van de in dat depot vervatte tekeningen of modellen.
Indien een licentie is ingeschreven kan de doorhaling van de inschrijving van de tekening of het model slechts worden verricht op gezamenlijk verzoek van de houder van de inschrijving en de licentiehouder. Het in de vorige volzin bepaalde is van overeenkomstige toepassing in het geval een pandrecht of een beslag is ingeschreven.
De doorhaling geldt voor het gehele Benelux-gebied ondanks andersluidende verklaring.
De in dit artikel opgenomen bepalingen gelden eveneens ten aanzien van de afstand van de bescherming die voor het Benelux-gebied uit een internationaal depot voortvloeit.
