Article 3.19

The exclusive right to a design or model does not imply the right to oppose:
acts in the private sphere and for non-commercial purposes;
acts for experimental purposes;
acts consisting of reproduction for the purpose of illustration or for teaching, provided that such acts are compatible with fair trade practices, do not unreasonably prejudice the normal exploitation of the design or model, and the source is indicated.
The exclusive right to a design or model does not include the right to oppose:
the equipment of vessels and aircraft registered in another country which are temporarily located within the Benelux territory;
the importation into the Benelux territory of replacement parts and accessories for the repair of such means of transport;
repairs to such means of transport.
The exclusive right to a design or model that constitutes a component part of a complex product does not include the right to oppose the use of the design or model for the purpose of the repair of that complex product so as to restore its original appearance.
The exclusive right to a design or model does not imply the right to oppose the acts referred to in Article 3.16 relating to products that have been put on the market in one of the Member States of the European Community or of the European Economic Area by the holder or with their consent, or to oppose acts as referred to in Article 3.20.
The claims cannot relate to products that were brought into circulation in the Benelux territory prior to the date of the filing.
Het uitsluitend recht op een tekening of model houdt niet in het recht zich te verzetten tegen:
handelingen in de particuliere sfeer en voor niet-commerciële doeleinden;
handelingen voor experimentele doeleinden;
handelingen bestaande in reproductie ter illustratie of ten behoeve van onderwijs, mits deze handelingen verenigbaar zijn met de eerlijke handelsgebruiken, zij niet zonder noodzaak afbreuk doen aan de normale exploitatie van de tekening of het model, en de bron wordt vermeld.
Het uitsluitend recht op een tekening of model houdt evenmin het recht in zich te verzetten tegen:
de uitrusting van in een ander land geregistreerde vaartuigen en luchtvaartuigen die zich tijdelijk binnen het Benelux-gebied bevinden;
de invoer in het Benelux-gebied van vervangingsonderdelen en toebehoren ter reparatie van dergelijke vervoermiddelen;
reparaties aan dergelijke vervoermiddelen.
Het uitsluitend recht op een tekening of model dat een onderdeel vormt van een samengesteld voortbrengsel houdt niet het recht in zich te verzetten tegen het gebruik van de tekening of het model voor reparatie van dit samengestelde voortbrengsel met de bedoeling het zijn oorspronkelijke uiterlijk terug te geven.
Het uitsluitend recht op een tekening of model houdt niet in het recht zich te verzetten tegen de in artikel 3.16 bedoelde handelingen die betrekking hebben op voortbrengselen die in één der lidstaten van de Europese Gemeenschap of van de Europese Economische Ruimte in het verkeer zijn gebracht door de houder of met diens toestemming, of tegen handelingen als bedoeld in artikel 3.20.
De vorderingen kunnen geen betrekking hebben op voortbrengselen die vóór de datum van het depot in het Benelux-gebied in het verkeer werden gebracht.
