1.

The curator shall not enjoy, directly or indirectly, any benefit from his position as curator other than the remuneration he receives for his curatorship. In particular:

a.

he shall not accept any gifts from the person placed under guardianship,

b.

he shall not purchase any property from the person placed under guardianship,

c.

he shall derive no benefit from the testamentary disposition which the person placed under guardianship has made during the guardianship, and

d.

he shall derive no benefit from any assignment he grants to himself or to a third party in the context of his curatorship.

2.

A benefit as referred to in paragraph 1, enjoyed by the following, shall be considered an indirect benefit for the liquidator (curator):

a.

persons through whom the curator performs his duties,

b.

the spouse, registered partner or other life companion, and a parent, child, brother or sister of the curator,

c.

insofar as the trustee (curator) is a legal person, the director, supervisory director or shareholder of the trustee,

d.

legal persons connected with the bankruptcy trustee (curator), by virtue of the fact that:

i.

the curator can exercise more than half of the voting rights in the general meeting of the legal person, or can appoint or dismiss more than half of the directors or of the supervisory directors of the legal person,

ii.

the legal person and the bankruptcy trustee (curator) form part of a group within the meaning of Article 24b of Book 2, or

iii.

the administrator (curator), director or supervisory director is of the legal person.

3.

Paragraphs 1 and 2 apply mutatis mutandis to administrators (bewindvoerders) and mentors (mentoren).

1.

De curator geniet, direct of indirect, geen ander voordeel uit zijn positie als curator dan de beloning die hij voor zijn curatorschap ontvangt. In het bijzonder:

a.

aanvaardt hij geen giften van de onder curatele gestelde,

b.

koopt hij geen goederen van de onder curatele gestelde,

c.

geniet hij geen voordeel uit de uiterste wilsbeschikking die de onder curatele gestelde gedurende de curatele heeft gemaakt, en

d.

geniet hij geen voordeel van enige opdracht die hij aan zichzelf of een derde verstrekt in het kader van zijn curatorschap.

2.

Als een indirect voordeel voor de curator wordt beschouwd een voordeel, bedoeld in het eerste lid, genoten door:

a.

personen door wie de curator zijn taak uitoefent,

b.

de echtgenoot, geregistreerde partner of andere levensgezel, en een ouder, kind, broer of zuster van de curator,

c.

voor zover de curator een rechtspersoon is, de bestuurder, commissaris of aandeelhouder van de curator,

d.

rechtspersonen verbonden met curator, doordat:

i.

de curator meer dan de helft van de stemrechten in de algemene vergadering van de rechtspersoon kan uitoefenen, dan wel meer dan de helft van de bestuurders of van de commissarissen van de rechtspersoon kan benoemen of ontslaan,

ii.

de rechtspersoon en de curator deel uitmaken van een groep in de zin van artikel 24b van Boek 2, of

iii.

de curator bestuurder of commissaris is van de rechtspersoon.

3.

Het eerste en tweede lid zijn van overeenkomstige toepassing op bewindvoerders en mentoren.
