The curator has a description of:
the registration and intake procedure
the execution of the curatorship, including communication with the person placed under curatorship,
the termination of the guardianship, including the transfer of the guardianship to the successor, and the termination of the curatorship (curatele),
the financial and administrative organisation, and, as the case may be,
the support
and operates in accordance with the described processes.
The trustee has incorporated safeguards for:
the accuracy of the inventory of the estate,
the recording and execution of the agreements made and instructions given for the benefit of the person placed under guardianship (onder curatele gestelde),
the accuracy of the rights and obligations of a patrimonial nature of the person under guardianship,
the reliability and continuity of the data processing,
the continuity of the activities in the event of illness or incapacity of the trustee, and
compliance with the requirements set forth in Article 9,
and operates in accordance with these safeguards.
The curator has a description of the various positions, in which the tasks and powers for each position are established, and acts in accordance with the described positions, unless the curator has no other person or persons through whom he exercises his tasks.
The functions of issuing payment orders are separated from the functions of disbursement and accounting, unless the trustee (curator) has no other person or persons through whom he performs his duties.
The curator shall ensure that he is sufficiently capable of compensating any damage caused to the person placed under curatorship by himself or by a person through whom he performs his duties, for example by having taken out professional liability insurance that provides sufficient annual coverage against claims.
Paragraphs 1 to 5 inclusive shall apply mutatis mutandis to administrators (bewindvoerders).
The first paragraph, the second paragraph, parts b, d, e and f, and the third and fifth paragraphs shall apply mutatis mutandis to mentors.
De curator heeft een beschrijving van:
de aanmelding en intakeprocedure,
de uitvoering van de curatele, daaronder begrepen de communicatie met de onder curatele gestelde,
de beëindiging van het curatorschap, daaronder begrepen de overdracht van het curatorschap aan de opvolger, en de beëindiging van de curatele,

de ondersteuning,
en werkt in overeenstemming met de beschreven processen.
De curator heeft waarborgen ingebouwd voor:
de juistheid van de boedelbeschrijving,
de vastlegging en uitvoering van de gemaakte afspraken en opdrachten ten behoeve van de onder curatele gestelde,
de juistheid van de rechten en verplichtingen van vermogensrechtelijke aard van de onder curatele gestelde,
de betrouwbaarheid en continuïteit van de gegevensverwerking,
de continuïteit van de werkzaamheden in geval van ziekte of uitval van de curator, en
het voldoen aan de in artikel 9 gestelde eisen,
en werkt in overeenstemming met deze waarborgen.
De curator heeft een beschrijving van de verschillende functies, waarin de taken en bevoegdheden voor iedere functie zijn vastgesteld, en werkt in overeenstemming met de beschreven functies, tenzij de curator geen andere persoon of personen heeft door wie hij zijn taken uitoefent.
De functies van het geven van opdracht tot betaling zijn gescheiden van de functie van uitbetaling en boekhouding, tenzij de curator geen andere persoon of personen heeft door wie hij zijn taken uitoefent.
De curator zorgt ervoor dat hij voldoende in staat is om eventuele door hem of door een persoon door wie hij zijn taken uitoefent veroorzaakte schade van de onder curatele gestelde te vergoeden, bijvoorbeeld door het hebben afgesloten van een verzekering tegen beroepsaansprakelijkheid die een voldoende jaarlijkse dekking biedt tegen schadegevallen.
Het eerste tot en met vijfde lid zijn van overeenkomstige toepassing op bewindvoerders.
Het eerste lid, het tweede lid, onderdelen b, d, e en f, en het derde en vijfde lid zijn van overeenkomstige toepassing op mentoren.
