The liquidator has at least:
successfully completed an appropriate programme in higher professional education as referred to in Article 1.1 of the Higher Education and Research Act, or
successfully completed a suitable vocational training as referred to in Article 7.2.2, paragraph 1, subparagraphs d and e, of the Adult and Vocational Education Act (Wet educatie en beroepsonderwijs) and has, for a period of at least two years and for a duration of at least 24 hours per week, performed the duties of a curator under the responsibility of a curator appointed by the subdistrict court.
The curator maintains and develops his knowledge and skills relevant to the curatorship by performing a refresher or training activity at least annually.
Paragraphs 1 and 2 apply mutatis mutandis to at least one natural person who represents the legal person acting as liquidator (curator).
The curator shall possess, for each person through whom he performs the duties of a curator, a copy of the proof that at least the education referred to in the first paragraph has been successfully completed.
The curator shall ensure the supervision of the persons through whom he exercises the tasks of a curator by conducting at least annual performance reviews and recording these in writing, and by enabling them annually to perform a continuing education or training activity as referred to in the second paragraph.
Paragraphs 1 to 5 inclusive shall apply mutatis mutandis to administrators (bewindvoerders).
The mentor shall have successfully completed at least an appropriate vocational training as referred to in Article 7.2.2, paragraph 1, parts d and e, of the Adult and Vocational Education Act. The first sentence shall apply mutatis mutandis to at least one natural person who represents the legal person acting as mentor. The second and fifth paragraphs shall apply mutatis mutandis to mentors. Insofar as a person through whom the mentor performs his duties has not completed a training as referred to in the first sentence, the mentor shall provide for the supervision of this person in the performance of his duties by a person who has successfully completed such training.
De curator heeft ten minste:
een passende opleiding in het hoger beroepsonderwijs als bedoeld in artikel 1.1 van de Wet op het hoger onderwijs en wetenschappelijk onderzoek met goed gevolg afgerond, of
een passende beroepsopleiding als bedoeld in artikel 7.2.2, eerste lid, onderdelen d en e, van de Wet educatie en beroepsonderwijs met goed gevolg afgerond en gedurende een periode van ten minste twee jaar voor de duur van ten minste 24 uur per week, de taken van een curator uitgeoefend onder verantwoordelijkheid van een door de kantonrechter benoemde curator.
De curator onderhoudt en ontwikkelt zijn voor het curatorschap van belang zijnde kennis en vaardigheden door ten minste jaarlijks een bijscholings- of trainingsactiviteit te verrichten.
Het eerste en tweede lid zijn van overeenkomstige toepassing op ten minste één natuurlijke persoon die de rechtspersoon die curator is, vertegenwoordigt.
De curator beschikt voor iedere persoon door wie hij de taken van een curator uitoefent over een afschrift van het bewijs dat ten minste de in het eerste lid bedoelde opleiding met goed gevolg is afgerond.
De curator draagt zorg voor de begeleiding van de personen door wie hij de taken van een curator uitoefent door ten minste jaarlijkse functioneringsgesprekken te voeren en deze schriftelijk vast te leggen en hen jaarlijks in staat te stellen om een bijscholings- of trainingsactiviteit als bedoeld in het tweede lid te verrichten.
Het eerste tot en met vijfde lid zijn van overeenkomstige toepassing op bewindvoerders.
De mentor heeft ten minste een passende beroepsopleiding als bedoeld in artikel 7.2.2, eerste lid, onderdelen d en e, van de Wet educatie en beroepsonderwijs met goed gevolg afgerond. De eerste volzin is van overeenkomstige toepassing op ten minste één natuurlijke persoon die de rechtspersoon die mentor is, vertegenwoordigt. Het tweede en vijfde lid zijn van overeenkomstige toepassing op mentoren. Voor zover een persoon door wie de mentor zijn taken uitoefent geen opleiding als bedoeld in de eerste volzin heeft afgerond, voorziet de mentor in de begeleiding van deze persoon in de uitoefening van zijn taken door een persoon die deze opleiding wel met goed gevolg heeft afgerond.
