Article 8
in forceWith respect to a petition for the change of the surname of a minor as referred to in Article 3, the following persons shall be heard, or at least shall be duly summoned for that purpose:
the parents of the child;
the person from whom the child directly derives the surname, the change of which has been petitioned;
the persons referred to in Article 3, paragraph 1, under (b) and under (c); as well as
the minor of twelve years of age or older.
With regard to a petition for a change of the surname of an adult as referred to in Articles 1 and 4, or for the addition of a surname, the following persons shall be heard, or at least shall be duly summoned for that purpose:
the person from whom the person of full age directly derives the surname for which a change is petitioned or to which an addition is petitioned;
the person whose surname is requested, if it concerns the change of a surname.
If the person referred to in paragraph 1, under (b), is deceased, his relatives in the first degree shall be heard on a petition (verzoek) as referred to in paragraph 1.
Ter zake van een verzoek tot wijziging van de geslachtsnaam van een minderjarige als bedoeld in artikel 3 worden gehoord, althans worden daartoe behoorlijk opgeroepen:
de ouders van het kind;
degene aan wie het kind de geslachtsnaam, waarvan wijziging is verzocht, rechtstreeks ontleent;
de in artikel 3, eerste lid, onder b en onder c, bedoelde personen; als mede
de minderjarige van twaalf jaren of ouder.
Ter zake van een verzoek tot wijziging van de geslachtsnaam van een meerderjarige als bedoeld in de artikelen 1 en 4, of toevoeging van een geslachtsnaam worden gehoord, althans daartoe behoorlijk opgeroepen:
degene aan wie de meerderjarige de geslachtsnaam waarvan wijziging is verzocht of waaraan toevoeging wordt verzocht, rechtstreeks ontleent;
degene wiens geslachtsnaam wordt verzocht, indien het de wijziging van een geslachtsnaam betreft.
Indien de in het eerste lid, onder b, bedoelde persoon is overleden, worden zijn bloedverwanten in de eerste graad op een verzoek als bedoeld in het eerste lid gehoord.
