Article 8
in forceIf a petition (application) as referred to in Article 7 is submitted to the clerk of the court and the estate has fallen open prior to the date of entry into force of this Decree, the clerk of the court shall ex officio verify whether facts concerning that estate have been registered in the designated register referred to in Article 1070 of Book 4 of the Civil Code (Burgerlijk Wetboek) as it applied prior to the aforementioned date.
Indien aan de griffier een verzoek als in artikel 7 bedoeld wordt gedaan en de nalatenschap voor het tijdstip van inwerkingtreding van dit besluit is opengevallen, gaat de griffier ambtshalve na of terzake van die nalatenschap feiten zijn ingeschreven in het daartoe bestemde register, bedoeld in artikel 1070 van Boek 4 van het Burgerlijk Wetboek zoals dat voor genoemd tijdstip gold.
