The patient has the right to address the supervisory committee, orally or in writing, with a request to mediate regarding a grievance concerning the manner in which the head of the institution has acted towards him in a particular matter or has observed a duty of care established by or pursuant to this Act. For the purposes of the application of this provision, an act of a staff member or employee of the institution towards the patient shall be regarded as an act of the head of the institution.
If the grievance concerns a decision against which a complaint may be lodged, this petition must be submitted no later than the seventh day following the day on which the person under treatment became aware of that decision.
The supervisory committee shall strive to reach a solution acceptable to both parties within four weeks. It may delegate the mediation, in whole or in part, to the monthly commissioner or to another member designated from among its number.
The supervisory committee shall provide the person under treatment and the head of the institution the opportunity to explain their position orally, whether or not in each other's presence. If the person under treatment does not have a sufficient command of the Dutch language, the supervisory committee shall ensure the assistance of an interpreter.
She shall conclude the mediation by communicating her findings to the head of the institution and the patient. In the cases referred to in Article 56, the patient shall be informed of the possibility of lodging a complaint, as well as the manner in which and the period within which this must be done.
If the head of the institution or the person under care so requests, a dated copy of the notification shall be sent or handed to him as soon as possible. The date of such dispatch or delivery shall be noted on this copy. If the person under care does not sufficiently understand the Dutch language, the supervisory committee shall ensure a translation of the notification is provided.
De verpleegde heeft het recht zich, mondeling of schriftelijk, tot de commissie van toezicht te wenden met het verzoek te bemiddelen ter zake van een grief omtrent de wijze waarop het hoofd van de instelling zich in een bepaalde aangelegenheid jegens hem heeft gedragen of een bij of krachtens deze wet gestelde zorgplicht betracht. Een gedraging van een personeelslid of medewerker van de instelling jegens de verpleegde wordt met het oog op de toepassing van deze bepaling als een gedraging van het hoofd van de instelling aangemerkt.
Indien de grief een beslissing betreft waartegen beklag openstaat, dient dit verzoek uiterlijk op de zevende dag na die waarop de verpleegde kennis heeft gekregen van die beslissing te worden ingediend.
De commissie van toezicht streeft ernaar binnen vier weken een voor beide partijen aanvaardbare oplossing te bereiken. Zij kan de bemiddeling geheel of ten dele aan de maandcommissaris of een ander uit haar midden aangewezen lid opdragen.
De commissie van toezicht stelt de verpleegde en het hoofd van de instelling in de gelegenheid, al dan niet in elkaars tegenwoordigheid, hun standpunt mondeling toe te lichten. Indien de verpleegde de Nederlandse taal niet voldoende beheerst, draagt de commissie van toezicht zorg voor de bijstand van een tolk.
Zij sluit de bemiddeling af met een mededeling van haar bevindingen aan het hoofd van de instelling en de verpleegde. In de gevallen, bedoeld in artikel 56, wordt de verpleegde gewezen op de mogelijkheid van beklag en de wijze waarop en de termijn waarbinnen dit moet worden gedaan.
Indien het hoofd van de instelling of de verpleegde hierom verzoekt, wordt hem zo spoedig mogelijk een gedagtekend afschrift van de mededeling toegezonden of uitgereikt. De datum van die toezending of uitreiking wordt op dit afschrift aangetekend. Indien de verpleegde de Nederlandse taal niet voldoende begrijpt, draagt de commissie van toezicht zorg voor een vertaling van de mededeling.
