If a staff member or employee of the institution observes that a patient is involved in acts that are incompatible with the order or safety within the institution or with the undisturbed course of the nursing care, and he intends to submit a written report thereon to the head of the institution, he shall inform the patient thereof.
The head of the institution shall decide on the imposition of a disciplinary measure as soon as possible after the report has been submitted to him.
If the head of the institution or his substitute establishes facts as referred to in the first paragraph, the first paragraph shall not apply.
Indien een personeelslid of medewerker van de instelling constateert dat een verpleegde betrokken is bij feiten die onverenigbaar zijn met de orde of de veiligheid in de instelling dan wel met een ongestoord verloop van de verpleging en hij voornemens is daarover aan het hoofd van de instelling schriftelijk verslag te doen, deelt hij dit de verpleegde mede.
Het hoofd van de instelling beslist over het opleggen van een disciplinaire straf zo spoedig mogelijk nadat hem verslag is gedaan.
Indien het hoofd van de instelling of zijn vervanger feiten als bedoeld in het eerste lid, constateert, blijft het eerste lid buiten toepassing.
