The patient has the right to send and receive letters and documents by post, subject to the restrictions to be imposed in accordance with the second through fifth paragraphs. Unless the head of the institution determines otherwise, the costs associated with this shall be borne by the patient.
The head of the institution is authorised to examine envelopes or other postal items originating from or intended for patients for the presence of enclosed objects and to open them for this purpose. The opening shall take place, insofar as possible, in the presence of the patient concerned. With regard to the patients referred to in Article 4, paragraph 1, under g, this authority applies only if the subdistrict court judge of the court of The Hague has issued an order to this effect.
The head of the institution is authorised to exercise supervision over the contents of letters or other postal items originating from or intended for the person being cared for, each time for a period of no more than four weeks, if this is necessary with a view to one of the following interests:
the protection of society against the danger posed by the person being nursed to the safety of others than the person being nursed or the general safety of persons or property;
the maintenance of order or security within the institution;
the averting of serious danger to the health of the person being nursed;
the protection of victims of, or other persons involved in, criminal offences committed by a person being nursed;
the prevention or detection of criminal offences.
The supervision referred to in the third paragraph may be limited to certain persons or bodies.
The head of the institution may refuse the dispatch or delivery of certain letters or other postal items, as well as enclosed objects, if this is necessary with a view to an interest as referred to in the third paragraph.
The head of the institution shall ensure that letters or other postal items, as well as enclosed objects, that have not been delivered are either returned to the patient or returned at the patient's expense to the sender or another address provided by the patient, or are kept on behalf of the patient against issuance of a receipt, or are destroyed in the patient's presence with the patient's consent, or are handed over to an investigative officer with a view to the prevention or detection of criminal offences.
De verpleegde heeft, behoudens de overeenkomstig het tweede tot en met vijfde lid te stellen beperkingen, het recht brieven en stukken per post te verzenden en te ontvangen. De hieraan verbonden kosten komen, tenzij het hoofd van de instelling anders bepaalt, voor rekening van de verpleegde.
Het hoofd van de instelling is bevoegd enveloppen of andere poststukken afkomstig van of bestemd voor verpleegden op de aanwezigheid van bijgesloten voorwerpen te onderzoeken en deze hiertoe te openen. Het openen geschiedt, voor zover mogelijk, in aanwezigheid van de betrokken verpleegde. Ten aanzien van de in artikel 4, eerste lid, onder g, genoemde verpleegden geldt deze bevoegdheid slechts indien de kantonrechter van de rechtbank Den Haag hiertoe de last heeft gegeven.
Het hoofd van de instelling is bevoegd op de inhoud van brieven of andere poststukken afkomstig van of bestemd voor de verpleegde telkens voor een periode van ten hoogste vier weken toezicht uit te oefenen, indien dit noodzakelijk is met het oog op één van de volgende belangen:
de bescherming van de maatschappij tegen de gevaarlijkheid van de verpleegde voor de veiligheid van anderen dan de verpleegde of de algemene veiligheid van personen of goederen;
de handhaving van de orde of de veiligheid in de inrichting;
de afwending van ernstig gevaar voor de gezondheid van de verpleegde;
de bescherming van slachtoffers van of anderszins betrokkenen bij door een verpleegde begane misdrijven;
de voorkoming of opsporing van strafbare feiten.
Het toezicht, bedoeld in het derde lid, kan worden beperkt tot bepaalde personen of instanties.
Het hoofd van de instelling kan de verzending of uitreiking van bepaalde brieven of andere poststukken alsmede bijgesloten voorwerpen weigeren, indien dit noodzakelijk is met het oog op een belang als bedoeld in het derde lid.
Het hoofd van de instelling draagt zorg dat de niet uitgereikte brieven of andere poststukken dan wel bijgesloten voorwerpen, hetzij worden terug gegeven aan de verpleegde of voor diens rekening worden teruggezonden aan de verzender of een ander door de verpleegde op te geven adres, hetzij onder afgifte van een bewijs van ontvangst ten behoeve van de verpleegde worden bewaard, hetzij met toestemming van de verpleegde in diens aanwezigheid worden vernietigd, hetzij aan een opsporingsambtenaar ter hand worden gesteld met het oog op de voorkoming of opsporing van strafbare feiten.
