The head of the institution may determine that a patient, during seclusion, shall have their freedom of movement restricted for a period of no more than twenty-four hours by the attachment of mechanical means to their body, if such restriction is necessary to avert a serious danger to the health or safety of the patient or that of others emanating from the patient. The head of the institution shall immediately notify the physician or their deputy and the supervisory committee of the attachment.
In the event of the application of Article 34, paragraph 3, the head of the department where the patient is staying may, in cases of urgent necessity, take a decision as referred to in the first paragraph. The head of the institution, the physician or their deputy, and the supervisory committee shall be notified thereof without delay.
The head of the institution may extend the application of mechanical means to the body of the patient, each time for a period of no more than twenty-four hours. The decision to extend shall be taken after consultation with a physician attached to the institution.
Our Minister shall establish further rules regarding the attachment of mechanical devices to the body.
Het hoofd van de instelling kan bepalen dat een verpleegde tijdens de separatie door bevestiging van mechanische middelen aan zijn lichaam voor een periode van ten hoogste vierentwintig uren in zijn bewegingsvrijheid wordt beperkt, indien die beperking noodzakelijk is ter afwending van een van de verpleegde uitgaand ernstig gevaar voor diens gezondheid of veiligheid of die van anderen. Het hoofd van de instelling stelt de arts of diens plaatsvervanger en de commissie van toezicht van de bevestiging onverwijld in kennis.
In geval van toepassing van artikel 34, derde lid, kan het hoofd van de afdeling waar de verpleegde verblijft bij dringende noodzakelijkheid een beslissing als bedoeld in het eerste lid nemen. Het hoofd van de instelling, de arts of diens plaatsvervanger en de commissie van toezicht worden hiervan onverwijld in kennis gesteld.
Het hoofd van de instelling kan de bevestiging van mechanische middelen aan het lichaam van de verpleegde telkens met ten hoogste vierentwintig uren verlengen. De beslissing tot verlenging wordt genomen na overleg met een aan de instelling verbonden arts.
