The head of the institution may compel a patient to undergo a specific medical act, other than a treatment as referred to in Article 16b, under (a) or (b), if, in the judgment of a physician, that act is strictly necessary to avert a danger to the health or safety of the patient or of others. The act, other than a treatment as referred to in Article 16b, under (a) or (b), shall be performed by a physician or, on their instructions, by a nurse.
Article 25, paragraph 2, shall apply mutatis mutandis.
Further rules regarding the application of the first paragraph shall be established by Order in Council. These rules shall in any event concern the notification and registration of the medical act. The Order in Council shall not enter into force earlier than eight weeks after the date of issue of the Bulletin of Acts and Decrees in which it is published. Notification of the publication shall be given without delay to both Houses of the States General.
Het hoofd van de instelling kan een verpleegde verplichten te gedogen dat ten aanzien van hem een bepaalde geneeskundige handeling wordt verricht niet zijnde een behandeling als bedoeld in artikel 16b, onder a of b, indien die handeling naar het oordeel van een arts volstrekt noodzakelijk is ter afwending van gevaar voor de gezondheid of de veiligheid van de verpleegde of van anderen. De handeling wordt verricht niet zijnde een behandeling als bedoeld in artikel 16b, onder a of b door een arts of, in diens opdracht, door een verpleegkundige.
Artikel 25, tweede lid, is van overeenkomstige toepassing.
Bij algemene maatregel van bestuur worden nadere regels gesteld omtrent de toepassing van het eerste lid. Deze regels betreffen in ieder geval de melding en de registratie van de geneeskundige handeling. De algemene maatregel van bestuur treedt niet eerder in werking dan acht weken na de datum van uitgifte van het Staatsblad waarin hij is geplaatst. Van de plaatsing wordt onverwijld mededeling gedaan aan de beide kamers der Staten-Generaal.
