The head of the institution may determine that a patient shall be subjected to a body search, if this is necessary to avert a serious danger to the maintenance of order or safety within the institution or a serious danger to the health or safety of the patient. The body search shall be performed by a physician or, under their instruction, by a nurse.
The head of the department where the patient is staying may, in cases of urgent necessity, take a decision as referred to in the first paragraph.
If, during an examination of the body, objects are found which the person being nursed is not permitted to possess, and these objects can be removed from the body by the physician or nurse, the head of the institution is authorised to seize them. Article 23, paragraph 5, last sentence, applies mutatis mutandis.
Het hoofd van de instelling kan bepalen dat een verpleegde in het lichaam wordt onderzocht, indien dit noodzakelijk is ter afwending van ernstig gevaar voor de handhaving van de orde of de veiligheid in de instelling of ernstig gevaar voor de gezondheid of de veiligheid van de verpleegde. Het onderzoek in het lichaam wordt verricht door een arts of, in diens opdracht, door een verpleegkundige.
Het hoofd van de afdeling waar de verpleegde verblijft kan bij dringende noodzakelijkheid een beslissing als bedoeld in het eerste lid nemen.
Indien bij het onderzoek in het lichaam voorwerpen worden aangetroffen die niet in het bezit van de verpleegde mogen zijn, en deze voorwerpen door de arts of verpleegkundige uit het lichaam kunnen worden verwijderd, is het hoofd van de instelling bevoegd deze in beslag te nemen. Artikel 23, vijfde lid, laatste volzin, is van overeenkomstige toepassing.
