The patient has the right to inspect the data recorded in the patient file, subject to the restrictions to be imposed in accordance with the second and third paragraphs.
The head of the institution may withhold certain information from the patient after a request for access to such information has been made, if this is necessary to avert a serious threat to the maintenance of order or safety within the institution or for the protection of the personal privacy of persons other than the patient.
The head of the institution may limit the right to inspect evaluation reports to a summary made thereof, if the nursing or treatment so requires.
In the event of the application of the second or third paragraph, the head of the institution may cause a person authorised by the patient to take cognisance of the data of which cognisance is withheld from the patient.
With regard to the nursing and treatment plan and the evaluation report, the right to inspect includes the right to receive a copy.
Pursuant to the provisions of Article 464 of Book 7 of the Civil Code, Article 456 of this Book shall not apply mutatis mutandis.
De verpleegde heeft, behoudens de overeenkomstig het tweede lid en derde lid te stellen beperkingen, recht op kennisneming van de in het verpleegdedossier vastgelegde gegevens.
Het hoofd van de instelling kan de verpleegde na een verzoek tot kennisneming van bepaalde gegevens hem deze onthouden, indien dit noodzakelijk is ter afwending van ernstig gevaar voor de handhaving van de orde of de veiligheid in de instelling of ter bescherming van de persoonlijke levenssfeer van anderen dan de verpleegde.
Het hoofd van de instelling kan het recht op kennisneming van evaluatieverslagen beperken tot een daarvan gemaakte samenvatting, indien de verpleging dit vereist.
Het hoofd van de instelling kan, in geval van toepassing van het tweede of derde lid, een door de verpleegde gemachtigde persoon doen kennis nemen van de gegevens waarvan de kennisneming aan de verpleegde onthouden wordt.
Voor wat betreft het verplegings- en behandelingsplan en het evaluatieverslag omvat het recht op kennisneming tevens het recht op het ontvangen van een afschrift.
Met toepassing van het bepaalde in artikel 464 van Boek 7 van het Burgerlijk Wetboek is artikel 456 van dit boek niet van overeenkomstige toepassing.
