By way of derogation from Article 8:79, paragraph 2, of the General Administrative Law Act, the provision of copies or extracts to persons other than the parties in accordance with that provision shall take place with the authorisation of the court.
With regard to written judgments, the authorisation referred to in the first paragraph shall only be omitted if, upon a petition submitted by one of the parties prior to the judgment, the court rules that even after anonymisation, the confidentiality of personal and financial data is insufficiently protected and, furthermore, the interest of the publicity of the administration of justice does not outweigh this interest.
In afwijking van artikel 8:79, tweede lid, van de Algemene wet bestuursrecht geschiedt de verstrekking overeenkomstig die bepaling van afschriften of uittreksels aan anderen dan partijen met machtiging van de rechtbank.
Met betrekking tot schriftelijke uitspraken blijft de machtiging, bedoeld in het eerste lid, slechts achterwege indien op een voor de uitspraak gedaan verzoek van een der partijen de rechtbank oordeelt dat ook na anonimisering de geheimhouding van persoonlijke en financiële gegevens onvoldoende wordt beschermd en bovendien het belang van de openbaarheid van de rechtspraak niet opweegt tegen dit belang.
