in forceThe following persons are authorised to grant an authorisation to enter:
the advocate general at the public prosecution service of the court of appeal (ressortsparket);
the public prosecutor;
the assistant public prosecutor.
Insofar as the law does not provide otherwise, the mayor is authorised to grant an authorisation to enter a dwelling located within his municipality for purposes other than criminal proceedings.
The person who is authorised to grant an authorisation shall only proceed to do so if the purpose for which the entry is made reasonably requires entry without the consent of the occupant.
Bevoegd tot het geven van een machtiging tot binnentreden zijn:
de advocaat-generaal bij het ressortsparket;
de officier van justitie;
de hulpofficier van justitie.
Voor zover de wet niet anders bepaalt, is de burgemeester bevoegd tot het geven van een machtiging tot binnentreden in een woning gelegen binnen zijn gemeente voor andere doeleinden dan strafvordering.
Degene die bevoegd is een machtiging te geven, gaat daartoe slechts over, indien het doel waartoe wordt binnengetreden het binnentreden zonder toestemming van de bewoner redelijkerwijs vereist.
