This Act and the provisions based thereon shall not apply to work performed on board a seagoing vessel that is not entitled to fly the flag of the Kingdom on the basis of legal rules applicable to the Netherlands and which is located in the exclusive economic zone, in the territorial sea, on one of the shipping routes referred to in Article 10, paragraph 1, of the Shipping Traffic Act (Scheepvaartverkeerswet), on the Western Scheldt, its estuaries, or on the Ghent-Terneuzen Canal, by persons belonging to the crew of that seagoing vessel.
By way of derogation from the first paragraph, this Act applies to harbour tugs and to diving activities for the benefit of mining installations, performed on or from seagoing vessels.
This Act and the provisions based thereon shall not apply to work performed for an employer established outside the Netherlands by persons employed on board an aircraft located in Dutch airspace or on Dutch territory.
Deze wet en de daarop berustende bepalingen zijn niet van toepassing op arbeid verricht aan boord van een zeeschip, dat niet op grond van voor Nederland geldende rechtsregels gerechtigd is de vlag van het Koninkrijk te voeren en dat zich bevindt in de exclusieve economische zone, in de territoriale zee, op een van de in artikel 10, eerste lid, van de Scheepvaartverkeerswet bedoelde scheepvaartwegen, op de Westerschelde, haar mondingen of op het Kanaal van Gent naar Terneuzen, door personen die behoren tot de bemanning van dat zeeschip.
In afwijking van het eerste lid is deze wet van toepassing op havensleepboten en op duikwerkzaamheden ten behoeve van mijnbouwinstallaties, verricht op of vanaf zeeschepen.
Deze wet en de daarop berustende bepalingen zijn niet van toepassing op arbeid, welke voor een buiten Nederland gevestigde werkgever, wordt verricht door personen, werkzaam aan boord van een luchtvaartuig dat zich in het Nederlandse luchtruim of op het Nederlandse territoir bevindt.
