An official designated for that purpose by Our Minister and falling under his authority shall impose the administrative fine upon the natural or legal person on whom the obligations rest arising from this Act and the provisions based thereon, insofar as the non-compliance therewith is designated as an offence.
Insofar as it concerns the categories of labour distinguished in Article 5:12, paragraph 2, an official designated for that purpose by Our Minister of Infrastructure and Water Management and Our Minister acting jointly shall impose the administrative fine upon the natural person or legal person on whom the obligations rest arising from this Act and the provisions based thereon, insofar as the non-compliance therewith is designated as an offence.
The contraventions established by virtue of this Act and the provisions based thereon shall apply in respect of each person with or towards whom the contravention has been committed, and with regard to each day during which such contravention has been committed.
If an employee who is in the service of an employer established outside the Netherlands performs work by order of that employer for an employer established in the Netherlands, the obligations arising from this Act and the provisions based thereon, insofar as these are designated as offences, shall also rest upon the aforementioned employer established in the Netherlands.
Een daartoe door Onze Minister aangewezen, onder hem ressorterende ambtenaar legt de bestuurlijke boete op aan de natuurlijke of rechtspersoon op wie de verplichtingen rusten welke voortvloeien uit deze wet en de daarop berustende bepalingen, voor zover het niet naleven daarvan is aangeduid als overtreding.
Voor zover het de in artikel 5:12, tweede lid, onderscheiden categorieën van arbeid betreft legt een daartoe door Onze Minister van Infrastructuur en Waterstaat en Onze Minister tezamen aangewezen ambtenaar de bestuurlijke boete op aan de natuurlijke persoon of rechtspersoon op wie de verplichtingen rusten welke voortvloeien uit deze wet en de daarop berustende bepalingen, voor zover het niet naleven daarvan is aangeduid als overtreding.
De ter zake van deze wet en de daarop berustende bepalingen gestelde overtredingen gelden ten opzichte van elke persoon, met of ten aanzien van wie de overtreding is begaan, en met betrekking tot elke dag in de loop waarvan deze overtreding is begaan.
Indien een werknemer die in dienst is van een buiten Nederland gevestigde werkgever in diens opdracht arbeid verricht voor een in Nederland gevestigde werkgever, rusten de verplichtingen welke voortvloeien uit deze wet en de daarop berustende bepalingen, voor zover deze zijn aangeduid als overtredingen, mede op de hiervoor bedoelde in Nederland gevestigde werkgever.
