By way of derogation from Article 9, for a pension beneficiary who does not reside in the Netherlands, the gross old-age pension shall be equal to the gross old-age pension for the pension beneficiary referred to in Article 9, paragraph 1, point (b), without prejudice to Article 13, paragraph 1.
Article 8a, paragraph 2, shall apply mutatis mutandis.
By or pursuant to an Order in Council, it may be determined that a person is entitled to an old-age pension as if he were a resident of the Netherlands:
the pension beneficiary, as referred to in Article 9, paragraph 1, point (a), who performs activities in the public interest and does not reside in the Netherlands;
the pension beneficiary, as referred to in Article 9, paragraph 1, point (a), who resides in Aruba, Curaçao, Sint Maarten or in the public bodies of Bonaire, Sint Eustatius and Saba; or
the family members of the pensioner referred to in points (a) or (b).
The pension beneficiary who does not reside in the Netherlands and is entitled to the following shall have the right to an old-age pension as if he were residing in the Netherlands:
an extraordinary pension, guarantee supplement, benefit, periodic payment, guarantee benefit, compensation or allowance as referred to in the Extraordinary Pensions Act 1940–1945, the Extraordinary Pensions Act for Seafarers War Victims, the Extraordinary Pensions Act for the Indonesian Resistance, the Benefits Act for Victims of Persecution 1940–1945, the Benefits Act for Civilian War Victims 1940–1945 or the General War Accidents Regulation Indonesia, including the decree of the Lieutenant Governor-General of the Netherlands East Indies of 5 November 1946 (Indisch Staatsblad, 1946, 118); or
a pension, allowance, benefit, compensation or contribution, comparable to a pension, allowance, benefit, compensation or contribution as referred to in part (a), pursuant to a foreign statutory scheme that is comparable to the statutory schemes mentioned in part (a).
In afwijking van artikel 9 is voor de pensioengerechtigde, die niet in Nederland woont, het bruto-ouderdomspensioen gelijk aan het bruto-ouderdomspensioen voor de pensioengerechtigde, bedoeld in artikel 9, eerste lid, onderdeel b, onverminderd artikel 13, eerste lid.
Artikel 8a, tweede lid, is van overeenkomstige toepassing.
Bij of krachtens algemene maatregel van bestuur kan worden bepaald dat recht heeft op ouderdomspensioen alsof hij in Nederland woont:
de pensioengerechtigde, bedoeld in artikel 9, eerste lid, onderdeel a, die werkzaamheden verricht in het algemeen belang en niet in Nederland woont;
de pensioengerechtigde, bedoeld in artikel 9, eerste lid, onderdeel a, die in Aruba, Curaçao, Sint Maarten of in de openbare lichamen Bonaire, Sint Eustatius en Saba woont; of
de gezinsleden van de in de onderdelen a of b bedoelde pensioengerechtigde.
Recht op ouderdomspensioen alsof hij in Nederland woont, heeft de pensioengerechtigde die niet in Nederland woont en recht heeft op:
een buitengewoon pensioen, garantietoeslag, uitkering, periodieke uitkering, garantie-uitkering, vergoeding of tegemoetkoming als bedoeld in de Wet buitengewoon pensioen 1940–1945, de Wet buitengewoon pensioen zeelieden-oorlogsslachtoffers, de Wet buitengewoon pensioen Indisch verzet, de Wet uitkeringen vervolgingsslachtoffers 1940–1945, de Wet uitkeringen burger-oorlogsslachtoffers 1940–1945 of de Algemene Oorlogsongevallenregeling Indonesië met inbegrip van het besluit van de Luitenant-Gouverneur-Generaal van Nederlands-Indië van 5 november 1946 (Indisch Staatsblad, 1946, 118); of
een pensioen, toeslag, uitkering, vergoeding of tegemoetkoming, vergelijkbaar met een pensioen, toeslag, uitkering, vergoeding of tegemoetkoming als bedoeld in onderdeel a, op grond van een buitenlandse wettelijke regeling die vergelijkbaar is met de wettelijke regelingen, genoemd in onderdeel a.
