For the application of Articles 8 and 10, income from employment shall be disregarded:
an amount equal to 15% of the gross minimum wage; as well as
insofar as the income from employment exceeds the amount referred to under 1°, one-third of that excess.
By way of derogation from the first paragraph, in the month in which the pensioner or the spouse of the pensioner has reached the pensionable age, the gross minimum wage, as referred to in the first paragraph, under 1°, shall be multiplied by the factor X/Y, where:
X stands for:
the number of days falling within the month in which the pension beneficiary reaches the pensionable age, from the day on which the pension beneficiary has reached this age, or
the number of days falling within the month in which the spouse of the pension beneficiary reaches the pensionable age, prior to the spouse having reached that age, and
Y represents the number of days of the month in which the pensioner or the spouse of the pensioner has reached the pensionable age.
Voor de toepassing van de artikelen 8 en 10 wordt van het inkomen uit arbeid buiten aanmerking gelaten:
een bedrag, gelijk aan 15% van het bruto-minimumloon; alsmede
voor zover het inkomen uit arbeid meer bedraagt dan het onder 1° bedoelde bedrag, een derde gedeelte van dat meerdere.
In afwijking van het eerste lid wordt in de maand waarin de pensioengerechtigde of de echtgenoot van de pensioengerechtigde de pensioengerechtigde leeftijd heeft bereikt, het bruto-minimumloon, bedoeld in het eerste lid, onder 1°, vermenigvuldigd met de factor X/Y, waarbij:
X staat voor:
het aantal dagen gelegen in de maand waarin de pensioengerechtigde de pensioengerechtigde leeftijd bereikt, vanaf de dag dat de pensioengerechtigde deze leeftijd heeft bereikt, of
het aantal dagen gelegen in de maand waarin de echtgenoot van de pensioengerechtigde de pensioengerechtigde leeftijd bereikt, voordat de echtgenoot deze leeftijd heeft bereikt, en
Y staat voor het aantal dagen van de maand waarin de pensioengerechtigde of de echtgenoot van de pensioengerechtigde de pensioengerechtigde leeftijd heeft bereikt.
